The Government issued Decree No. 300/2025/ND-CP stipulating the framework for the number of Vice Chairmen of the People's Committee, the number and structure of members of the People's Committee; the order and procedures for requesting approval of the results of the People's Council's election, dismissal, and removal of the Chairman and Vice Chairmen of the People's Committee; the order and procedures for transferring and removing the Chairman and Vice Chairmen of the People's Committee and delegating the authority of the Chairman of the People's Committee.
Authority to approve election results, dismissal, removal
According to regulations, the Prime Minister approves the results of the election, dismissal, and removal of the Chairman and Vice Chairman of the Provincial People's Committee; decides to transfer and remove the Chairman and Vice Chairman of the Provincial People's Committee and assigns the authority of the Chairman of the Provincial People's Committee.
The Chairman of the Provincial People's Committee approves the results of the election, dismissal, and removal of the Chairman and Vice Chairman of the Commune People's Committee; decides to transfer and remove the Chairman and Vice Chairman of the Commune People's Committee and delegates the authority of the Chairman of the Commune People's Committee.
Cases where election, dismissal, and removal are not required
The Decree stipulates that the Chairman and Vice Chairman of the People's Committee are transferred by the Prime Minister or the Chairman of the Provincial People's Committee to take on other duties; or are dismissed by the Prime Minister or the Chairman of the Provincial People's Committee, they do not have to carry out the procedures for dismissal or removal. The Standing Committee of the People's Council shall report to the People's Council of the same level at the nearest session in these cases.
Members of the People's Committee who are decided by competent authorities to retire, cease holding office, resign or pass away do not have to carry out dismissal procedures. The Standing Committee of the People's Council shall report to the People's Council of the same level at the nearest session in these cases.

A member of the People's Committee elected by the People's Council to hold a new position but still a member of the People's Committee of that administrative unit does not have to go through the dismissal procedure. When elected to a new position, he/she will naturally cease to perform the duties of the old position.
The head of a specialized agency under the People's Committee who is currently a member of the People's Committee and is appointed by a competent authority to hold the position of head of another specialized agency under the People's Committee of that administrative unit does not have to follow the procedure for electing and dismissing a member of the People's Committee.
The person with the authority to appoint is responsible for reporting to the Standing Committee of the People's Council so that the Standing Committee of the People's Council can report to the People's Council of the same level at the nearest session in this case.
Framework of the number of Vice Chairmen of the Provincial People's Committee
According to regulations, for provincial-level administrative units formed after the 2025 arrangement, the number of Vice Chairmen of the Provincial People's Committee is prescribed as follows:
For cities:
For Ho Chi Minh City, there are no more than 8 Vice Chairmen of the People's Committee. A city formed by the reorganization of 3 provincial-level administrative units has no more than 7 Vice Chairmen of the People's Committee; a city formed by the reorganization of 2 provincial-level administrative units has no more than 6 Vice Chairmen of the People's Committee.
For provinces:
A province formed by the reorganization of two provinces, of which at least one has been classified as a type I province according to the administrative unit classification before the reorganization, or a province formed by the reorganization of three provinces has no more than six Vice Chairmen of the People's Committee.
A province formed by the reorganization of two provinces, both of which were classified as type II or type III provinces according to the administrative unit classification before the reorganization, shall have no more than five Vice Chairmen of the People's Committee.
For provincial-level administrative units that do not implement the 2025 arrangement, the number of Vice Chairmen of the Provincial People's Committee is prescribed as follows:

For cities: Hanoi City has no more than 5 Vice Chairmen of the People's Committee. Hue City has no more than 4 Vice Chairmen of the People's Committee.
For provinces: The number of Vice Chairmen of the Provincial People's Committee is determined according to the classification of administrative units before the effective date of this Decree (November 17, 2025): Type I provinces have no more than 4 Vice Chairmen of the People's Committee; Type II and Type III provinces have no more than 3 Vice Chairmen of the People's Committee.
After November 17, 2025, if a type II province and a type III province are classified as a type I province, there will be no more than 4 Vice Chairmen of the People's Committee.
The Decree clearly states that for provinces and cities with Resolutions of the National Assembly and documents of competent authorities stipulating the number of Vice Chairmen of the People's Committees of provinces and cities different from the provisions of this Decree, the Resolutions of the National Assembly and documents of competent authorities shall apply.
In case the Politburo and the Secretariat implement the policy of mobilizing and rotating cadres to hold the position of Vice Chairmen of the People's Committee at the provincial level, the Vice Chairmen of the People's Committee due to mobilization and rotation shall be outside the number of Vice Chairmen of the People's Committee prescribed above.
Framework of the number of Vice Chairmen of the People's Committee at the commune level
The Decree stipulates that the number of Vice Chairmen of the People's Committee at the commune level is calculated on the principle of an average of no more than 2.5 Vice Chairmen of the People's Committee for each commune-level administrative unit.
Based on the total number of Vice Chairmen of the People's Committee at the commune level of the entire province or city according to regulations, the Provincial People's Committee shall decide on the specific number of Vice Chairmen of the People's Committee at each commune level in accordance with the natural area, population size, classification of administrative units, level of socio-economic development and practical situation of the locality, but must ensure that it does not exceed the total number of Vice Chairmen of the People's Committee at the commune level of the entire province or city.
Number and structure of People's Committee members at provincial and commune levels
Members of the Provincial People's Committee include heads of specialized agencies under the Provincial People's Committee, members in charge of military affairs, and members in charge of public security.
Members of the People's Committee at the commune level include the heads of specialized agencies under the People's Committee at the commune level, the members in charge of military affairs, and the members in charge of public security.
The number of members of the People's Committees at provincial and communal levels who are heads of specialized agencies under the People's Committees at provincial and communal levels shall comply with the Government's regulations on the organization of specialized agencies under the People's Committees of provinces and cities and the People's Committees of communes, wards and special zones under provinces and cities.
Transitional provisions
In provincial administrative units formed after the 2025 arrangement, if the number of Vice Chairmen of the Provincial People's Committee at the end of the 2021-2026 term is more than the prescribed number, then at the beginning of the 2026-2031 term, the number of Vice Chairmen of the Provincial People's Committee at the end of the 2021-2026 term will be kept the same as at the end of the 2021-2026 term.
The People's Committees of provinces and cities must have a roadmap to gradually reduce the number of Vice Chairmen of the Provincial People's Committee so that by July 2030, the number of Vice Chairmen of the Provincial People's Committee will comply with the provisions of this Decree, except in cases where competent authorities have other regulations.
Decree 300/2025/ND-CP takes effect from November 17, 2025./.
