Regulations on overtime pay for teaching Physical Education?

I am a primary school teacher, trained as a basic teacher of cultural subjects. Every year, the school board assigns me to be the homeroom teacher. In my locality, schools organize 2 sessions/day, with a total of 33 lessons/week.

During the week, teachers are given 10 periods off from specialized subjects including: Music (1 period), Fine Arts (1 period), Physical Education (2 periods), English (4 periods), Information Technology (2 periods). In reality, teachers have to teach 23 periods/week.

May I ask, are teachers at my school entitled to overtime pay? In the 2023-2024 school year, teachers will have to teach Physical Education concurrently, leading to overtime. So, are teachers entitled to overtime pay for teaching Physical Education and practice allowances as well as physical education teacher uniforms? (nguyentuyet***@gmail.com)

According to Circular No. 05/2025/TT-BGDDT dated March 7, 2025 of the Minister of Education and Training stipulating the working regime for general education and university preparatory teachers, the average teaching period per week for primary school teachers is 23 periods, teachers who concurrently hold the position of homeroom teacher are reduced by 4 periods/week.

Joint Circular No. 07/2013/TTLT-BGDĐT-BNV-BTC dated March 8, 2013 on overtime pay regime clearly states the principle: “Overtime pay shall only be paid in units or departments that lack teachers as approved by competent authorities. In cases where there is no shortage of teachers, payment shall only be made when someone is absent due to illness, maternity, schooling, or other duties assigned by competent authorities and needs another teacher to teach instead.”

To be considered for payment of overtime, please report to the school principal and request the school to confirm the shortage of subject teachers, or to assign concurrent positions according to the approved plan. On that basis, the school can carry out the procedure for payment of overtime if the conditions are met according to regulations.

Regarding the regime for physical education teachers, the compensation regime and the uniform regime for physical education teachers and lecturers are implemented according to the provisions of Decision No. 51/2012/QD-TTg dated November 16, 2012 of the Prime Minister.

Accordingly, physical education teachers are entitled to a allowance equal to 1% of the general minimum wage for 1 practical lesson; for part-time teachers and lecturers (teachers of other subjects who also teach physical education and sports) they are provided with 1 set of long-sleeved sports clothes/year, 1 pair of sports shoes/year, 2 pairs of sports socks/year, 2 short-sleeved sports shirts/year.

Therefore, we recommend that you report to the school principal for guidance and resolution of the regime according to regulations.
