At the meeting, the National Assembly Standing Committee listened to Chairman of the Economic Committee Vu Hong Thanh present the Report on the examination of the draft Law amending and supplementing a number of articles of the Land Law, Housing Law, Real Estate Business Law, and Law on Credit Institutions.
The meeting also heard Minister of Natural Resources and Environment Dang Quoc Khanh clarify some contents so that the Law amending and supplementing a number of articles of the Land Law, Housing Law, Real Estate Business Law, and Credit Institutions Law will soon create more favorable conditions for businesses and people in exercising their rights as land users, protecting the rights of people whose land has been recovered, promoting participation in real estate business activities, housing development, especially social housing, renovating and rebuilding apartment buildings, strictly controlling the development of multi-storey and multi-apartment housing of individuals, resolving disputes and complaints regarding the management and operation of apartment buildings, etc.
Deputy Prime Minister Tran Hong Ha also made additional remarks on improving the effectiveness of state management of land use by organizations and individuals; at the same time, promoting decentralization, delegation of authority and enhancing the responsibility of local authorities in the management and use of land, housing, and real estate business; ensuring real estate business, implementing comprehensive, public, transparent, strict housing policies, using land economically and effectively...
After listening to the opinions and concluding the content of the session, Vice Chairman of the National Assembly Nguyen Duc Hai stated that the National Assembly Standing Committee highly appreciated the Government's determination in speeding up the implementation of the Land Law, Housing Law, Real Estate Business Law, and Credit Institutions Law; the Government has made great efforts to develop and complete the draft law dossier.
The Economic Committee has been very responsible, objective and comprehensive in conducting the examination and pointing out many issues that need to be implemented to ensure the feasibility of the draft law; at the same time, expressing its support for the policy of bringing the four laws into life soon.
In addition, the Government and ministries and branches have also explained relevant points at the request of the auditing agency with a very open-minded spirit and supplemented necessary documents to continue serving the auditing process.
The Vice Chairman of the National Assembly emphasized that, through discussion and implementation of the direction of the Chairman of the National Assembly, the Standing Committee of the National Assembly agreed to submit to the National Assembly for consideration and decision the draft Law amending and supplementing a number of articles of the Land Law, Housing Law, Real Estate Business Law, and Law on Credit Institutions.
At the same time, the Government is requested to promptly issue and direct ministries, branches and localities to issue guiding documents to ensure quality and progress, and fully prepare conditions for the implementation of the law from August 1, 2024. Carefully review the transitional provisions, ensure consistency, synchronization, feasibility, and no overlap or contradiction within each law, between laws and the legal system. Clearly and fully identify the risks, challenges and negative consequences of adjusting the time, validity and transitional provisions of the laws to have solutions to control and overcome them.
In addition, the Government needs to commit and take full responsibility before the National Assembly and the People for the effectiveness of adjusting the enforcement and transitional provisions of the laws as explained in the Government's Submission. Do not create legal or legal gaps or allow negativity, policy exploitation, legalization of violations, and group interests. Do not cause obstacles, congestion, and difficulties for localities, people, and businesses, hindering development. Do not create negative legal effects, affecting the rights of affected subjects, the investment and business environment, the legitimate rights and interests of people and businesses, and credit institutions, leading to social reactions, complaints, and lawsuits affecting security, order, and social safety.
The Vice Chairman of the National Assembly said that in addition to the above contents, the National Assembly Standing Committee also contributed some specific opinions; suggested that the Government study and fully absorb the opinions of the National Assembly Standing Committee and the opinions of the reviewing agencies to complete the draft law dossier to submit to the National Assembly Standing Committee and the National Assembly.
The Economic Committee presides over and coordinates with the Law Committee and relevant agencies to officially examine and submit to the National Assembly for consideration and decision at the Seventh Session under the simplified procedure.
The Secretary General of the National Assembly shall prepare a report to the National Assembly on the adjustment of the session agenda, arrange time for presentation to the National Assembly, group discussion, discussion in the hall and voting to pass the draft Law appropriately and in accordance with regulations.
