Innovation to bring the Law into life sooner

Speaking first at the discussion session, delegate Pham Van Hoa (Dong Thap) expressed his agreement to amend and supplement a number of articles of 4 laws, postponing the effective date by 5 months according to the Government's Proposal. According to delegate Hoa, out of a total of 260 articles of the Land Law, 97 articles have been assigned to the Government, ministries, branches, and provincial People's Councils to specify detailed instructions for the implementation of the law. The remaining contents of the law can be implemented and promoted effectively, especially the compensation, restitution, resettlement support policies, land policies for ethnic minorities, overseas Vietnamese who are Vietnamese citizens. Regulations on expanding the land use limit for subjects who are allowed to transfer agricultural land use rights, land lease with annual payment of public service units, bank mortgages, etc.

To ensure that the law is effectively implemented early and has a great impact on the people, delegates hope that the Government will focus on directing ministries, branches and localities to promptly issue detailed guidance documents under their authority, ensuring quality and progress, and avoiding problems due to the lack of specific documents submitted to competent authorities for timely signing and promulgation, after these laws are passed on August 1, 2024, for easy implementation, without discrepancies, inadequacies, obstacles and in a timely manner.

Delegate Nguyen Truc Anh (Hanoi) expressed his high agreement with the Economic Committee's review proposal, agreeing to adjust the effective date to August 1 for four laws.

According to the delegate, we are looking forward to this law coming out soon and "it solves a series of problems, from decentralization, decentralization, expanding the list to release compensation, creating a compensation mechanism and releasing land for localities, a very open land fund creation mechanism, we are also looking forward to it." - delegate Truc Anh expressed.

The delegate saw that the Government this time was determined to issue circulars and decrees committed to the National Assembly early, which I consider very innovative. Normally, the delay is always 6 months to 1 year, this time we can issue them earlier, the economy will develop, so I think it is an effort. “Therefore, once again, I recommend that we be more daring and more innovative so that this law can come into effect sooner.”

For delegate Nguyen Thi Quyen Thanh (Vinh Long), she saw the Government's great determination in soon putting these laws into practice to overcome bottlenecks and difficulties, helping to free up resources and develop the country's socio-economy.

The delegates hope that the Government will pay special attention to the recommendations and opinions of the National Assembly delegates so that the issuance of circulars and decrees can ensure quality. We hope that the Government will continue to pay attention and create favorable conditions to support localities in issuing documents according to simplified procedures so that by August 1, relevant contents can be institutionalized.

According to the delegate, some current laws have overlaps, contradictions, and many shortcomings in understanding and implementation. Many state officials violate the law and get caught up in legal trouble, which is partly due to those shortcomings. Many officials avoid and shirk responsibility for fear of responsibility, which is also due to those shortcomings. Therefore, the sooner the laws come into effect, the sooner the above situation will be improved.

Delegate Ha Sy Dong also suggested that it is necessary to identify and fully assess the impact and influence of some provisions of the Land Law taking effect 5 months earlier on the investment and business environment, the legitimate rights and interests of people and businesses, especially the reactions and psychology of society. Before passing the law, the drafting agency should send to the National Assembly issues that may arise when the above laws take effect early, if any, how to resolve them, which agency is responsible for resolving them...

Delegate Nguyen Quang Huan (Binh Duong province delegation) said that real estate businesses are currently facing many difficulties. If this sector can be cleared, it will have a positive impact on the economy and GDP growth in the last 6 months of 2024.

According to the delegate, there are FDI enterprises that want to expand production but are currently having to stop because of the law. FDI enterprises have plans to allocate capital, and any delay could lead to restructuring or changing investment areas. Therefore, the sooner the law is enacted, the better.

Delegate Nguyen Quang Huan suggested that the Government urgently issue decrees guiding the implementation of these laws so that localities can feel secure; organize mass training to complete the local guidelines; the Government should also anticipate emerging risks and ways to respond...

Delegate Vu Tien Loc (Hanoi delegation) also agreed to pass this draft law. The delegate highly appreciated the Government's efforts in making institutional breakthroughs when submitting the draft "1 law amending 4 laws", with the determination to implement it soon, taking responsibility for any difficulties or problems. In the context of fear of making mistakes, the Government has courageously overcome this concern. That spirit, according to the delegate, needs to be encouraged.

Speaking to clarify a number of issues raised by National Assembly deputies, Minister of Natural Resources and Environment Dang Quoc Khanh informed that, through discussion, the majority of deputies highly agreed with the draft law submitted by the Government, especially wishing that these laws on land, housing, and real estate would take effect soon to meet the interests of people and businesses, and resolve the backlog in localities.

Minister Dang Quoc Khanh emphasized that the Land Law is probably the only law passed after 4 sessions of the National Assembly, demonstrating caution and thoroughness. Before passing, a wide consultation was organized with more than 12 million comments from the people. In particular, many contents and provisions of the Land Law, Housing Law, and Real Estate Business Law that were previously contained in circulars and decrees have now been specified in the law. Therefore, many contents of these laws can be implemented immediately without the need for guidance documents.

Along with that, Minister Dang Quoc Khanh said that, in parallel with the process of completing and revising the laws, the Government has also drafted decrees and guiding documents, so the Government's preparations for the Law on Real Estate Business and the Law on Housing have been carried out very carefully.

In fact, the Housing Law and the Real Estate Business Law were passed in October 2023 and are expected to take effect on July 1, 2024. However, because the Land Law was delayed for another session, to synchronize its effectiveness with the Land Law, the Housing Law and the Real Estate Business Law also delayed their effective date from January 1, 2025 (at the same time the Land Law takes effect).

Continuing to answer the opinions of National Assembly deputies interested in the decrees and regulations guiding the implementation of the above law from localities, the Minister of Natural Resources and Environment said that, in fact, since the National Assembly passed the Land Law (January 2024), the Government and the Prime Minister have directed relevant ministries, branches, and drafting agencies to start completing the decrees and circulars.

Minister Dang Quoc Khanh informed that, right from the time the National Assembly pressed the button for the Land Law, the drafting agency and relevant agencies started to develop decrees and circulars according to regulations. Therefore, the process is not shortened here, meaning that the process of issuing legal documents has been fully implemented; only the time of law enforcement is shortened, but the process and quality of the decrees and circulars are not shortened.
