(CPV) - The Ministry of Health stated that the Provincial People's Committee is responsible for organizing the implementation of receiving and declaring prices of milk products and functional foods for children under 6 years old according to the provisions of the law on prices, ensuring convenience for organizations and individuals to make declarations.
The Ministry of Health has just issued Circular 33 regulating the economic and technical characteristics of milk and functional foods for children under 6 years old subject to price stabilization and price declaration.

According to the Circular, milk for children under 6 years old is subject to price stabilization and price declaration, including the following product categories:
Formulated nutritional products for children up to 36 months old according to national technical standards issued by the Ministry of Health ;
Milk and nutritional products containing animal milk in powder or liquid form are declared for use for children under 6 years old but do not comply with national technical regulations issued by the Ministry of Health or the Ministry of Industry Management.
Functional foods for children under 6 years old subject to price declaration include the following product categories:
Health food;
Medical nutritional foods (also known as nutritional foods for special medical purposes);
Food supplements;
Food for special diets (milk free).
Economic and technical characteristics of milk and functional foods for children under 6 years old subject to price stabilization and price declaration
Circular 33 of the Ministry of Health clearly states that milk and functional foods for children under 6 years old are subject to price stabilization and price declaration including the following economic and technical characteristics:
1. Product name (detailed name);
2. Product classification;
3. Product form (dosage form/ dosage form);
4. Product declaration registration receipt number or product self-declaration number.
Circular stipulating economic and technical characteristics for milk and functional foods for children under 6 years old subject to price stabilization and price declaration takes effect from January 1, 2025.
Accordingly, Circular No. 30/2013/TT-BYT dated October 4, 2013 of the Ministry of Health promulgating the List of milk for children under 6 years old, which are goods subject to price stabilization, and Circular No. 22/2018/TT-BYT dated September 12, 2018 of the Ministry of Health regulating the List of functional foods for children under 6 years old, which are subject to price declaration, cease to be effective from the effective date of Circular 33.
In Circular 33, the Ministry of Health clearly states that the People's Committees at the provincial level are responsible for organizing the implementation of price declaration reception in accordance with the provisions of law on prices to ensure convenience for organizations and individuals to make declarations.
The Department of Food Safety - Ministry of Health issued a document requesting the Agency assigned by the Provincial People's Committee to receive price declarations to send the declared prices to the Ministry of Health (through the Department of Food Safety) to assess the level of fluctuations in market prices and develop a price stabilization report.
Organizations and individuals declaring milk and functional foods for use by children under 6 years old in the declaration dossier and on the product label (including products declared for use by multiple age groups, including children under 6 years old) are responsible for sending price declaration documents to the Agency assigned by the Provincial People's Committee to receive price declarations according to the provisions of Clause 1, Article 17 and Clause 2, Article 18 of Decree No. 85/2024/ND-CP dated July 10, 2024 of the Government detailing a number of articles of the Law on Prices.
The Ministry of Health assigned the Department of Food Safety to preside over and coordinate with relevant units to guide the implementation and organization of Circular 33. The Ministry of Health also stated that in the process of implementing this Circular, if there are any difficulties or problems, organizations and individuals should report to the Ministry of Health (through the Department of Food Safety) for consideration and resolution.
Thus, according to Circular 33, functional foods for children under 6 years old must declare prices with additional foods for special diets (not containing milk).
Previously, Circular No. 30/2013/TT-BYT dated October 4, 2013 of the Ministry of Health promulgating the List of milk for children under 6 years old, which are goods subject to price stabilization, and Circular No. 22/2018/TT-BYT dated September 12, 2018 of the Ministry of Health stipulating the List of functional foods for children under 6 years old, which are subject to price declaration, did not classify this product./.
