Currently, the city has a situation where resettlement land has not been arranged for households to be cleared (resettlement plots) and the reserve land for development (large land areas) has not been used or exploited. The city is implementing Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the 2024 Land Law. This is a legal condition to soon implement short-term vacant land leasing to solve the above-mentioned specific problem of Da Nang .

In recent times, due to the large number of resettlement plots and large areas of land, management has been ineffective. Meanwhile, resources for implementing barriers and cleaning the environment are still limited and there is a lack of mechanisms and legal regulations for organizations and individuals to rent and use temporary premises for socio -economic development, so there are situations where plots and areas of land are encroached upon, used for the wrong purpose or abandoned, causing environmental pollution, loss of security and order, and waste of land resources...
Vice Chairman of Son Tra District People's Committee Nguyen Hoang Viet said that in the district, there are 27 large plots of land being used as temporary parking lots, coffee shops, refreshment shops, ornamental plant businesses, temporary shops... and 7 plots of land being used as parks, walking gardens, libraries, and school expansions; the remaining 53 large plots of land and nearly 1,500 resettlement plots are left empty.
From 2022, the District People's Committee will handle temporary constructions and architectural structures on vacant lots and plots of land to hand over to the Da Nang City Land Fund Development Center. For areas and plots of land planned for auction from 2024-2025, the District will dismantle all illegal constructions on the land; but during the time when the auction is not successful, it is necessary to fence or level the land for cleaning, regularly cut grass to ensure aesthetics and the environment or can hand over to associations and organizations to build clean vegetable gardens and grow short-term vegetables.
For land areas proposed to be retained for public purposes such as school expansion, construction of cultural facilities, parks, walking gardens, etc., the city needs to hand them over to the district to fence, clean and carry out investment preparation work. For land areas that are not in short-term use or reserved land, the district proposes that the city allow planting of trees to green the land and ensure the environment.
“The city needs to decentralize the sharing of data on the management information system of vacant land areas and lots to localities for convenient capture, management and proposal of use. At the same time, according to the 2024 Land Law and Decree No. 102/2024/ND-CP of the Government, which stipulate the management and exploitation of short-term land funds, the city needs to soon issue regulations on the order and procedures for exploiting (leasing) short-term land funds to contribute to minimizing environmental pollution, loss of urban aesthetics, and waste of land resources...”, Mr. Nguyen Hoang Viet suggested.
According to the City Land Fund Development Center, the unit has coordinated to update and publicize all public land funds on the city land information portal with 345 large land plots and 19,986 resettlement plots. To manage this vacant land fund, the Department of Natural Resources and Environment has established a working group to inspect, handle encroachment, illegal construction, and protect the environment for public land funds managed by the City Land Fund Development Center and regularly coordinate with localities and units to perform tasks. The unit has also deployed the installation of protective fences for 15 vacant land plots in prime locations, which are often littered with debris, causing loss of aesthetics, urban areas, and the environment...
Director of the Da Nang City Land Fund Development Center Huynh Tan Quang said that Decree No. 102/2024/ND-CP of the Government stipulates that the task of the land fund development center is to make a list and organize short-term leasing of land plots and land lots assigned for management but without a decision on land allocation or land lease; The provincial People's Committee shall specify the procedures for short-term land fund leasing in the locality. To implement the above regulations, the City Land Fund Development Center has advised the Department of Natural Resources and Environment to report and propose to the City People's Committee to develop regulations on procedures for short-term land fund exploitation.
Currently, the draft procedure for short-term land leasing is being consulted. The City Land Fund Development Center will receive and complete the draft and submit it to departments, branches and sectors for appraisal to report to the City People's Committee for consideration and decision.
Later, based on the list of land funds and unit prices approved by the City People's Committee, the City Land Fund Development Center will publicly announce to select organizations and individuals with land lease applications and the highest proposed rental unit price to sign land lease contracts; in case there is only one organization or individual with land lease application and proposed land lease unit price not lower than the starting price approved by the City People's Committee, the land lease contract will be signed.
Land rental fees and property attached to land are included in revenue and accounted for according to the provisions of law for public service units.
