On the morning of October 31, continuing the program of the 10th Session of the 15th National Assembly , the National Assembly worked in the hall to listen to the Government's Report and the Verification Report of the Committee on National Defense, Security and Foreign Affairs on the draft Law on Protection of State Secrets (amended).

Presenting the Government 's Report, Minister of Public Security Luong Tam Quang said that the draft Law on Protection of State Secrets (amended) consists of 5 chapters and 28 articles, of which 7 articles are kept intact and 21 articles are amended and supplemented.

According to Minister Luong Tam Quang, the draft Law on State Secrets Protection has a number of new points as follows:

Expanding the permission to draft and store State secrets on a computer network that is an independent LAN, established within the headquarters of an agency or organization, without having to encrypt with a cipher, in order to thoroughly remove obstacles in the 2018 Law on Protection of State Secrets and meet the requirements of national digital transformation.

Add regulations prohibiting the use of artificial intelligence systems to violate state secrets.

Supplementing authority and responsibility in State secret protection activities for commune-level authorities and a number of central agencies, organized according to a regional model.

Supplement and complete regulations on handling documents containing state secret content in the electronic environment.

Abolish a number of regulations and administrative procedures within local agencies, organizations and units related to state secret protection activities.

Regarding decentralization and delegation of power, the Minister of Public Security said that the draft Law has stipulated thorough decentralization to departments, ministries, branches and provincial and communal levels, especially communal and regional levels in State secret protection activities, in order to increase the authority and responsibility of agencies, organizations and localities in State secret protection activities.

Specify specific criteria as a basis for promulgating the list of State secrets.

Examining the draft Law on State Secrets Protection (amended), Chairman of the National Defense, Security and Foreign Affairs Committee Le Tan Toi said that the National Defense, Security and Foreign Affairs Committee basically agreed with the contents of the draft Law, in which most of the contents were inherited from the relevant provisions of the current Law; with some adjustments and supplements to institutionalize the Party's policies and directions, and overcome difficulties and problems arising in practice.

Regarding the classification of State secrets, Article 8 classifies State secrets into 3 levels, so it is necessary to clarify specific criteria as a basis for promulgating the list of State secrets in Article 9 and determining State secrets and the level of State secrecy in Article 10.

Regarding the content of determining State secrets, determining the level of confidentiality, and the period of protection of State secrets: The Committee for National Defense, Security and Foreign Affairs proposes to supplement regulations on: Responsibility for reviewing the subjects receiving documents and containers of State secrets; criteria for deciding to extend the period of protection of State secrets and the maximum level of extension time; the process of determining and stamping the level of confidentiality for electronic documents of State secrets.

Regarding the regulation on removing documents and objects containing State secrets from storage, the Chairman of the National Defense, Security and Foreign Affairs Committee said that removing the regulation on approval when removing documents and objects containing State secrets from storage could create loopholes in the management and protection of State secrets, due to the current lack of approval, control and strict monitoring.

Referring to the responsibility of agencies and organizations to protect State secrets, the Chairman of the National Defense, Security and Foreign Affairs Committee proposed to stipulate the responsibility of the Government Cipher Committee in implementing State management in this field to be consistent with the provisions of the Law on Cipher and in accordance with the functions and tasks of the Government Cipher Committee.
