Minister of Finance Nguyen Van Thang said that the goal of the Resolution is to promptly institutionalize a number of the Party's policies and guidelines stated in Resolution No. 68-NQ/TW to improve the investment and business environment; create favorable conditions for the private economy to access resources; promote science, technology, innovation and digital transformation, green transformation, human resource training, expand the participation of private enterprises in important national projects, support pioneering enterprises, and reach international standards to create "pushes, levers, and fulcrums" to create new momentum, liberate resources, and productivity of the private economy. Thereby, realizing the goals stated in Resolution No. 68-NQ/TW.
The draft Resolution focuses on institutionalizing five major policy groups, including: Improving the business environment; Supporting access to land resources and production and business premises; Supporting finance, credit and public procurement; Supporting science , technology, innovation, digital transformation and human resource training; Supporting the formation of medium and large enterprises and pioneering enterprises.
Regarding the scope of regulation, the draft Resolution stipulates a number of special mechanisms and policies for private economic development; the subjects of application are enterprises, business households, business individuals and other relevant organizations and individuals.
Regarding improving the business environment, the principles of inspection and examination of enterprises, business households and individual businesses (Article 4), the draft Resolution stipulates that each enterprise and business household cannot be inspected more than once a year, except in cases where there is clear evidence of violations.
Strictly handle acts of abusing inspection and examination to harass and cause difficulties for businesses. At the same time, prioritize remote inspection and examination based on electronic data, reduce direct inspection and examination. Exempt actual inspection for businesses that comply well with legal regulations.

Shift the management of business conditions from licensing and certification to publishing business conditions and post-inspection, except for a few fields that are required to carry out licensing procedures according to international regulations and practices.
Regarding the principles of handling violations and resolving cases in business activities (Article 5), the draft Resolution clearly defines the responsibilities of legal entities and the responsibilities of individuals; between criminal responsibilities and administrative responsibilities, civil responsibilities; and between administrative responsibilities and civil responsibilities.
Accordingly, for violations and cases of civil and economic nature, priority is given to applying civil, economic and administrative measures first; enterprises, business households and business individuals are allowed to proactively remedy violations and damages. In cases where the practical application of the law may lead to criminal prosecution or no criminal prosecution, criminal prosecution shall not be applied.
For violations that are subject to criminal prosecution, priority is given to proactive, timely and comprehensive economic remedial measures first and is an important basis for the prosecution agency to consider when deciding to initiate, investigate, prosecute, try and take further measures.
Presenting the review report, Chairman of the Economic and Financial Committee Phan Van Mai said that the Economic and Financial Committee agreed with the necessity, political and legal basis and practicality of developing and promulgating the Resolution according to the simplified procedures; agreed with the scope of regulation and scope of institutionalization of Resolution No. 68-NQ/TW in the draft Resolution of the National Assembly as proposed by the Government.
The content of the draft Resolution is consistent with the Constitution of the Socialist Republic of Vietnam; ensures requirements on national defense and security; ensures requirements on administrative procedure reform. According to Submission No. 427/TTr-CP and Report No. 429/BC of the Government, the draft Resolution ensures compatibility with relevant international treaties to which the Socialist Republic of Vietnam is a member. The draft Resolution dossier is eligible to be submitted to the National Assembly for consideration and approval at the 9th Session.
To ensure the quality of the draft Resolution submitted to the National Assembly for consideration and approval, the Economic and Financial Committee requests that the drafting agency continue to review and fully institutionalize the policies and orientations in the Resolution of the 11th Conference of the 13th Party Central Committee, Resolution No. 66-NQ/TW, Conclusion No. 119-KL/TW and Regulation No. 178-QD/TW.
To ensure full institutionalization of Resolution No. 68-NQ/TW, and at the same time, ensure the consistency and long-term stability of the legal system, the Economic and Financial Committee recommends that the Government:
Direct the agency in charge of drafting other draft laws and resolutions to submit to the National Assembly at the 9th Session to urgently review and study the contents of Resolution No. 68-NQ/TW to institutionalize them in these draft laws and resolutions, and soon have official documents sent to the National Assembly and the National Assembly Standing Committee.
Direct the review of other contents with clear content and objectives that can be concretized into tasks and solutions for socio-economic development in the last months of 2025 to be included in the General Resolution of the 9th Session.
Research and propose legislation to promptly supplement the 2025 Legislative Program, submit to the National Assembly for consideration and approval at the 10th Session and provide legislative direction for the 16th National Assembly term.
To ensure effective implementation, the Economic and Financial Committee recommends that the Government direct the review of the draft Law on State Budget (amended) and balance resources to implement mechanisms and policies according to the Resolution as concluded by the National Assembly Standing Committee.
