Giving his opinion during the discussion, delegate Pham Van Hoa ( Dong Thap ) expressed his agreement with the draft adding regulations that the investigator is the chief or deputy chief of the commune-level police.

Accordingly, intermediate-level investigators or higher (of provincial-level police investigation agencies) are chiefs and deputy chiefs of commune-level police assigned by the head of provincial-level police investigation agencies to have the authority to initiate and investigate criminal cases of less serious and serious crimes with a maximum penalty of up to 7 years in prison occurring in commune-level areas.

Mr. Hoa said that after leaving the district police, investigation activities at the grassroots level are facing many difficulties. When initiating an investigation or prosecuting a suspect, the case file must be brought to the provincial police for approval by the deputy head of the investigation agency. After joining the province, he found it extremely difficult. If something happened in the commune, the case file must be brought to the provincial police.

He cited an example like in Dong Thap, merged with Tien Giang, the capital is in My Tho, the provincial police will be located in My Tho.

"So the incident that happened in Dong Thap had to travel hundreds of kilometers to the provincial police to approve the file. Sometimes the case was already approved, and the criminal could have escaped after approving the file to temporarily detain him," said Mr. Hoa.

He suggested strengthening the investigation activities of the commune police . Accordingly, it is necessary to organize regional investigation agencies, to have similarities between the investigation, prosecution and trial agencies. Although there may be an increase in staff, the delegate thinks it will not be much.

He said that when organizing a regional investigation agency, there would be no need for investigators at the commune police station, and at the same time create similarities with the regional court and prosecutor's office.

Delegate Nguyen Thi Le (HCMC) also expressed support for this policy to be consistent with the orientation of increasing capacity at the grassroots level, ensuring timeliness in resolving cases.

However, to ensure effectiveness and legality, she suggested that it is necessary to carefully review and specifically and strictly regulate the authority of this force so that it is consistent with the capacity of the commune-level police and ensures real effectiveness in crime prevention and control.

Delegate Le stated that granting more authority to commune-level police must go hand in hand with clearly defining standards of capacity and minimum legal expertise for investigators.

It is not simply a matter of assigning investigators from the provincial level, but also of having specialized training and professional development programs, especially in basic investigative skills, evidence collection and evaluation, and special attention must be paid to the mechanism of power control.

She also suggested considering a roadmap, we can implement it cautiously and pilot it in some areas, then have conditions before widely applying it.

Speaking afterwards, delegate Nguyen Thanh Sang (HCMC) said that with the expected force of the Ministry of Public Security reporting, investigators at the commune police will be professional investigators from the district and provincial police reinforced down. Therefore, it is completely possible to meet the requirements.

"This is a professional force and exercises the authority assigned by the head of the investigation agency, so they have the right to prosecute, investigate, and implement procedural measures according to the provisions of the current Code of Criminal Procedure," Mr. Sang added.

Large, key communes in Hanoi and Ho Chi Minh City can arrange 50 - 60 police officers.

Explaining later, Chief Justice of the Supreme People's Procuracy Nguyen Huy Tien stated that the addition of authority to the chief and deputy chief of the commune police as investigators with the authority to investigate and prosecute comes from practical requirements.

Because after the district police ended, the investigation activities were "extremely complicated and needed to be supplemented".

He pointed out that for the first time, the investigation force was organized at the commune level. Meanwhile, previously, the commune police were only assigned some tasks, but did not have to carry out investigation tasks.

Agreeing with the delegates' opinions on the need to strengthen the capacity of the communal police force when assigning the authority to investigate and prosecute cases, Mr. Tien said that the number of investigators in the communal police force will be strengthened from the provincial and district levels.

He informed that according to the report of the Ministry of Public Security, "the number of police officers will be arranged from 30 to 40, even in key areas such as Hanoi, Ho Chi Minh City, large communes there may be from 50 to 60 police officers and the number of investigators may be from 6 to 7 or from 8 to 10".

He added that this code stipulates that intermediate-level investigators or higher who are chiefs or deputy chiefs of police are allowed to exercise certain powers directly delegated through the law by the chief or deputy chief of the investigation agency.

This officer is in charge of commune-level investigators to carry out the work, not just one investigator.

Such force arrangement is to prosecute and investigate cases and incidents that are so serious that the maximum penalty is 7 years in prison.
