The Government proposes a series of mechanisms to encourage private participation in railway investment.

On the afternoon of May 27, authorized by the Prime Minister, Minister of Construction Tran Hong Minh presented a report on the draft Law on Railways (amended).

Emphasizing the need to amend the law to institutionalize the Party's policy of creating institutional breakthroughs for railway development, Minister Tran Hong Minh said that in mobilizing maximum resources for railway infrastructure development, the state budget plays a leading role, attracting all economic sectors;

Applying and developing modern science and technology in the railway sector to meet the requirements of multimodal transport and people's travel needs.

Encourage organizations and individuals to invest in railways

To develop railways, the Government proposes regulations for investment in developing railway infrastructure. This includes maximizing the mobilization of local resources and other economic sectors to participate in investing in the construction of railway infrastructure.

Organizations and individuals participating in railway investment are encouraged through many forms of contracts (BT, BOT, BTO, BLT, BTL...).

Localities are allowed to use their budgets to participate in compensation, resettlement support, and investment in the construction of some items. Supplementing regulations clearly defining the responsibilities of entities in investing in the construction of railway works.

To shorten and simplify the order and procedures for investment implementation, the draft also adds regulations on: applying overall technical design (FEED design) instead of basic design;

Provincial People's Committees are allowed to immediately decide to establish, appraise and decide on investment in urban railway projects without having to carry out procedures on investment policies.

The addition of this regulation is one of the breakthrough solutions to remove bottlenecks in investment procedures for the local urban railway system, contributing to realizing Conclusion No. 49 of the Politburo on accelerating the investment process and completing the urban railway network in Hanoi and Ho Chi Minh City by 2035.

Along with that are policies on management and exploitation of railway infrastructure; railway transport activities. Connecting transport modes, ensuring synchronization and efficiency between railway lines and between railways and other transport modes.

Developing railway industry and human resources in the direction of prioritizing investment, with conditions binding foreign contractors to transfer technology and train human resources for Vietnamese partners to master management, operation, exploitation, etc.

The Government also emphasized the reduction and simplification of administrative procedures and business conditions and the promotion of decentralization and delegation of power. According to Mr. Huy, the draft law has basically institutionalized and is consistent with the guidelines and policies. However, it is necessary to evaluate more carefully the real level of "breakthrough" in the mechanisms and policies, the ability to strongly attract investment from the private economic sector, and promote socialization in the railway sector.

In addition, it is necessary to review and ensure full compliance with Regulation No. 178 of the Politburo on controlling power, preventing corruption and negativity in law-making, to identify and give early warnings of potential risks of group interests, local interests or loopholes that can be exploited in law-making...

To institutionalize Resolution 57, the drafting agency needs to continue researching and institutionalizing to accelerate the application of scientific and technical advances in the railway sector in the coming time, such as driverless train control technology; testing mechanisms for some new forms of railway trains (such as magnetic levitation trains, trains in vacuum tubes, etc.).

According to the inspection agency, railway is a strategic form of transport, playing a key role in national security.

However, the current draft law only stops at general regulations on the role of railways in national defense and security, without specific and detailed regulations.
