The legal system has developed strongly, becoming increasingly synchronous and accessible.
Speaking at the Forum, Chairman of the Economic and Financial Committee Phan Van Mai stated that our country is entering a new era and is facing two hundred-year goals: by 2030, it will become a developing country with modern industry and high average income, and by 2045, it will become a developed country with high income. In the effort to achieve these goals, perfecting and synchronizing institutions for a socialist-oriented market economy is identified as a strategic breakthrough, becoming an endogenous resource creating new momentum for rapid and sustainable development.

In recent times, the Central Committee has issued important thematic resolutions, especially Resolution 21-NQ/TW in 2008 on continuing to perfect the socialist-oriented market economic institution, Resolution 11-NQ/TW on perfecting the socialist-oriented market economic institution, laying the theoretical and practical foundation for perfecting the socialist-oriented market economic institution. The 12th and 13th Party Congresses have continued to raise the level of institutional thinking, emphasizing the need to synchronously perfect the institutional system according to the standards of a modern market economy and deep international integration; focusing on removing bottlenecks in law-making and enforcement, on synchronous and complete development of market factors and on improving the operational efficiency of enterprises.
In particular, in the new period, the Politburo has just issued many strategic resolutions, notably Resolution 66 on innovation in law-making and enforcement, which positions legal work as the center of development creation; Resolution No. 57-NQ/TW on breakthroughs in science and technology development, innovation and national digital transformation is considered the most important tool to create rapid growth, breakthroughs and overcome the middle-income trap; Resolution No. 68-NQ/TW on private economic development, affirming that the private economy is one of the most important driving forces of the economy. The Politburo is also preparing to issue a resolution on the state economy to clarify the leading role of this sector in the socialist-oriented market economy.

With that attention, the Chairman of the Economic and Financial Committee affirmed that the legal system has developed strongly, becoming increasingly synchronous, transparent, accessible, and covering quite comprehensively all areas from ownership, investment, business to science, technology and social security. The institutionalization of the Party's policies in the past term has also been carried out quickly and synchronously, contributing to removing many bottlenecks and creating favorable conditions for development.
Promote new business areas
However, from the perspective of the Economic and Financial Committee, Chairman Phan Van Mai also pointed out the limitations. Specifically, many legal regulations are still overlapping, contradictory, and have not kept up with reality; the thinking of law-making in some areas is still heavy on management; decentralization and delegation of power are not strong enough; administrative procedures are still cumbersome; the cost of law compliance is high; the organization of law enforcement is still a weak link and policy response is slow; the legal framework for new areas is still lacking, there is a risk of falling behind in international competition.
“This is a huge challenge for us. If we do not innovate in time and do not innovate strongly and synchronously, the institution may become a bottleneck instead of a driving force for development in the new period,” the Chairman of the Economic and Financial Committee stated.
To continue perfecting the law on socialist-oriented market economy, the Chairman of the Economic and Financial Committee emphasized three recommendations.

Firstly, strongly innovate the thinking of law-making. Build a transparent, modern legal framework, focusing on people and businesses. Strongly shift from management to creation, creating space for law application for people, businesses and enforcement agencies. Fully and promptly institutionalize the Party's policies, promote the incorporation of Party resolutions into laws; ensure consistency and connectivity between laws, decrees and circulars, and not let institutional lag hinder development.
Second, urgently review Review the legal system; perfect the legal system for new economic sectors. Complete the goal of perfecting the legal system on investment and business by 2028, bringing Vietnam's investment environment to the top 3 of ASEAN as per Resolution No. 66-NQ/TW. Economic and financial institutions must "lead the way", especially in new sectors such as science and technology, innovation, digital economy, green economy...; create a flexible legal framework for strong development of the private economy; promote new business sectors such as smart urban economy, low-level economy, space economy, cross-border business...

In perfecting the legal system on economics and finance, Chairman of the Committee Phan Van Mai proposed prioritizing the perfection of laws in five important areas: land, planning, real estate; finance, banking, capital market; enterprises, investment, competition; digital economy, data, innovation; energy, labor, environment and sustainable development.
Tuesday, Innovate and improve the effectiveness and efficiency of law enforcement. Shift from “pre-inspection” to “post-inspection”, eliminate the request-grant mechanism; strengthen coordination between legislative, executive and judicial agencies. Establish a mechanism for quick and effective policy response; emphasize the space for law enforcement by people, businesses and enforcement agencies as well as compliance assessment or enforcement assessment by competent agencies.

Along with that, it is necessary to design laws and organize law enforcement to ensure legal security for relevant entities, encourage and protect those who dare to think and act for the common good, and unleash resources for development.
“Reforming and perfecting the law on the socialist-oriented market economy is not only an urgent task but also a prerequisite for Vietnam to develop rapidly and sustainably, and to enhance its national position. When the law truly becomes a driving force for development and a national competitive advantage, we can completely realize the aspiration to build a prosperous and happy country and steadily enter the new era,” the Chairman of the Economic and Financial Committee believes.
