Land previously allocated and leased to Trung Nguyen Coffee Joint Stock Company is being reclaimed due to the termination of the investment project.

(Lam Dong Online) - The Lam Dong Provincial People's Committee has decided to revoke the land previously allocated and leased to Trung Nguyen Coffee Joint Stock Company for the implementation of the Trung Nguyen Legend Coffee Exhibition and Display Area Project in Loc An commune, Bao Lam district. After revocation, these land plots will be handed over to the Loc An Commune People's Committee for management.

Accordingly, the Department of Natural Resources and Environment (now the Department of Agriculture and Environment) issued Land Use Right Certificates No. CH 546642 dated November 27, 2017, and No. CH 546643 dated November 27, 2017, for a total area of ​​15,529 m² belonging to land parcels No. 70 and 129, map sheet No. 30 (F.104.4), Loc An commune, Bao Lam district.

The reason for land reclamation is that the enterprise terminated the investment project as per Decision No. 1655/QD-UBND dated September 19, 2022, of the Provincial People's Committee (which includes a violation of point i, clause 1, Article 64 of the 2013 Land Law, now clauses 8 and 9, Article 81 of the 2024 Land Law).

According to the land reclamation decision, the State will not compensate for land and assets attached to the land as stipulated in Clause 3, Article 101 and Clauses 1 and 2, Article 105 of the 2024 Land Law.

Trung Nguyen Coffee Joint Stock Company is responsible for complying with the land revocation decision; handing over the land and land use right documents to the competent authority as stipulated in the land revocation decision; and fulfilling all financial obligations related to land and other financial obligations (if any) as prescribed by law.

The Provincial People's Committee assigns the People's Committee of Loc An commune, Bao Lam district, the responsibility to receive and strictly manage the allocated land area in accordance with the land law and other relevant laws, preventing any encroachment or illegal occupation of the allocated land; regularly organize inspections, detect, prevent, and promptly handle violations of land law within its authority as prescribed.

The People's Committee of Bao Lam District is responsible for organizing the enforcement of the land recovery decision as stipulated in Article 39 of Government Decree No. 102/2024/ND-CP dated July 30, 2024; allocating funds or proposing the allocation of funds for the enforcement of land recovery in accordance with the law in case Trung Nguyen Coffee Joint Stock Company fails to comply with the land recovery decision; monitoring, detecting, preventing, and promptly handling violations of the law on land management and use in the locality within its authority (as stipulated in point a, clause 1, Article 241 of the Land Law 2024), ensuring compliance with the law.

Furthermore, the Provincial People's Committee also assigned the Department of Agriculture and Environment the responsibility to preside over and coordinate with relevant agencies and units to organize the handover of the reclaimed land to the People's Committee of Loc An commune, Bao Lam district, for management according to regulations; to prepare procedures for revoking the land use right certificates previously issued to Trung Nguyen Coffee Joint Stock Company; and to direct the updating and correction of land database and cadastral records according to regulations.

The Provincial Tax Department (now the Regional Tax Office XIII) is responsible for inspecting, reviewing, and collecting any outstanding financial obligations that Trung Nguyen Coffee Joint Stock Company must fulfill (if any) from the date of issuance of this Decision onwards, as stipulated.
