General Secretary To Lam: Laws are not created to serve any particular group, but for the entire population.

Attending the discussion at the Hanoi National Assembly Delegation, General Secretary To Lam noted that law-making agencies must change their law-making mindset from management to service.

Proposal for regulations on citizen protection in case of multiple nationality

On the afternoon of May 17, the National Assembly discussed in groups the draft Law amending and supplementing a number of articles of the Law on Vietnamese Nationality; the draft Law on State Budget (amended); the draft Law amending and supplementing a number of articles of the Law on Bidding; the Law on Investment under the public-private partnership model; the Customs Law; the Law on Export Tax and Import Tax; the Investment Law; the Law on Public Investment; and the Law on Management and Use of Public Assets.

At the Hanoi National Assembly Delegation, contributing ideas to the draft Law on State Budget, Deputy Hoang Van Cuong highly appreciated the innovative spirit of this law, which is the policy of strengthening the role of localities in autonomy to create investment resources, not relying on the central budget.

According to Deputy Hoang Van Cuong, the capital city of Hanoi has a Capital Law to implement. This is the capital of 100 million people, a country with a position, but looking at the appearance of the capital, it is not much better than many other countries. Therefore, Deputy Hoang Van Cuong suggested that there should be a fundamental change in the appearance of the capital. In particular, focusing on solving pressing issues such as the environment (including urban railways).

"In the Capital planning, we have calculated and proposed an investment level of 9.5 million billion VND, with a budget of about 27.5%. Hanoi must create its own budget for investment and the Capital Law also clearly stipulates this," said Deputy Hoang Van Cuong, suggesting that it is necessary to retain the regulatory mechanisms as the Capital Law already has for Hanoi to develop.

Participating in giving comments on the draft Law on Vietnamese Nationality, Deputy Do Duc Hong Ha said that the draft has not yet clearly stated the special mechanism for naturalization. If it is not clearly stated, the feasibility will be limited and it will be difficult to employ high-quality human resources, and it will be difficult to meet the requirements of science and technology development and innovation. Therefore, Deputy Do Duc Hong Ha suggested continuing to clarify the special mechanism for naturalization; suggested reviewing related laws when there are provisions to expand the subjects of naturalization for connectivity, synchronization and unification.

Deputy Do Duc Hong Ha also proposed digitizing administrative procedures to simplify procedures and processes for naturalization; there should be a specific roadmap to create favorable conditions for related subjects.

Deputy Tran Thi Nhi Ha agrees with the draft law recognizing multiple nationalities, in accordance with international and legal practices of many countries. This is a humane policy to maintain the relationship between Vietnamese people residing abroad and the Fatherland. However, the Deputy believes that the draft lacks provisions on citizen protection in cases of multiple nationalities. Therefore, the Deputy proposes to add the principle of determining effective nationality in cases of multiple nationalities, as a basis for Vietnam to exercise its rights and obligations to protect citizens when there are legal risks abroad...

Changing the way of thinking about law

After listening to 10 delegates' comments, General Secretary To Lam pointed out that the legal system is the driving force and foundation for development, because everyone must work according to the law. Therefore, building and perfecting the law is to manage society and behavior.

According to the General Secretary, there is no time to amend all the laws, so we have to "run and queue at the same time". With the goal of reform, the General Secretary requires a fundamental change in the thinking of law-making, shifting from management to service thinking, from passive to proactive and creating for development. Law-making must be one step ahead, highly predictive, suitable to reality and development requirements.

Along with that, General Secretary To Lam suggested that law enforcement must be strict, fair, and substantial, closely linked to publicity, transparency, and maximum convenience for people, businesses, and society.

"The law is not created to serve any group, not to serve the interests of any group, but to serve the entire people, society, and all subjects. Along with that, decentralization and delegation of power are associated with responsibility and the elimination of the mechanism of asking for and giving, eliminating local interests," General Secretary To Lam reminded the agencies that draft and build laws. According to the General Secretary, with such a mindset, when going into specific laws, we will have a vision.

According to the General Secretary, the authorities are currently drafting additional resolutions on education and training, on protecting and taking care of people's health, in a spirit of urgency. Going into specific comments, the General Secretary directed that for the draft Law amending and supplementing a number of articles of the Law on Vietnamese Nationality, it is necessary to demonstrate the honor, the Vietnamese nation, solidarity, gathering forces, and the role of each individual in the law.

"Nationality or passports are sacred things," the General Secretary affirmed. At the same time, he noted that the draft Law on Vietnamese Nationality needs to mobilize strength and honor those who contribute to the country (foreigners). In addition, the General Secretary also noted that although the revised Law on Nationality has many "open" provisions, there should be regulations to punish those who take advantage of the openness of the Law on Nationality to falsify documents and other related crimes.

Regarding the draft laws amending and supplementing a number of articles of the Law on Bidding; Law on Investment under the public-private partnership model; Law on Customs; Law on Export Tax and Import Tax; Law on Investment; Law on Public Investment; Law on Management and Use of Public Assets, General Secretary To Lam acknowledged that these are very difficult issues that need to be resolved.

According to the General Secretary, for many years we have had money but could not spend it, the need to develop the country is very large, we have to borrow capital from abroad while we have money but cannot spend it. The General Secretary asked questions and cited evidence, if according to the Bidding Law, the process would take years (must go through several months of selecting contractors, several months of opening bids, several months of evaluating bids...). "I said, to amend the Bidding Law, we must have a summary, consider convicting the bidders, the crimes are very serious, these crimes are the crime of slowing down development progress, the crime of poor quality, the crime of corrupting cadres", the General Secretary emphasized.

Continuing to give comments on the draft Law amending and supplementing a number of articles of the Law on Bidding, the General Secretary cited that in bidding in the health sector, if bidding continues as it is now, patients will not have access to advances in world medicine. "Hospitals still provide medicine but no one takes it, which is a waste. People cannot access advances in international medicine," the General Secretary stated the current situation and requested that law-making agencies remove obstacles in related laws to unlock resources for national development.
