Ho Chi Minh City bans land subdivision and sale.

(Dan Tri Newspaper) - Ho Chi Minh City has banned land subdivision and sale throughout the entire city, including the five districts of Binh Chanh, Nha Be, Hoc Mon, Cu Chi, and Can Gio.


The Ho Chi Minh City People's Committee has just issued Decision No. 83/2024 regulating the determination of areas where real estate project investors and housing construction project investors are allowed to transfer land use rights with existing technical infrastructure to organizations and individuals for self-construction of housing in the city. The regulation takes effect from October 21st.

Ho Chi Minh City stipulates that investors in real estate projects and housing construction projects throughout the city are prohibited from transferring land use rights for land with existing infrastructure within the project to organizations or individuals for self-construction of housing.

The above regulations apply except in cases where the investor aims to resettle people using land plots in communes, towns, or districts of Ho Chi Minh City, provided that the conditions stipulated in the 2023 Law on Real Estate Business and the 2024 Law on Land apply.

Thus, the decision stipulates that project developers throughout Ho Chi Minh City are not allowed to subdivide and sell land plots within their projects to organizations or individuals for self-construction of houses, including all five districts of Binh Chanh, Nha Be, Hoc Mon, Cu Chi, and Can Gio.

The Ho Chi Minh City People's Committee stated that during the implementation of the decision, if any difficulties or obstacles beyond their authority arise, relevant agencies, units, organizations, and individuals should promptly report them to the Department of Construction for compilation and submission to the City People's Committee for consideration and guidance, or for appropriate amendments and additions.

Ho Chi Minh City previously announced a draft ban on land subdivision and sale in five suburban districts (Binh Chanh, Nha Be, Hoc Mon, Cu Chi, and Can Gio), which met with much opposition. Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association (HoREA), stated that the ban on land subdivision and sale in these five districts is inconsistent with the provisions of the 2023 Real Estate Business Law.

According to this law, Ho Chi Minh City is a special urban area, and only in cases where land is located within the wards, districts, or city areas of this special urban area (comprising 16 districts and Thu Duc City), the investor of a real estate or housing project is prohibited from transferring the right to use land with technical infrastructure to individuals for self-construction of houses.

For the five suburban districts, the Association has observed that residents want to acquire land use rights with existing infrastructure within real estate and housing projects so they can build their own homes. Therefore, HoREA proposes that the Department of Construction consider this matter.
