The draft Law on Forces Participating in Protecting Security and Order at the Grassroots Level was recently commented on at the 25th Session of the National Assembly Standing Committee on the afternoon of August 18.

The National Assembly Standing Committee requested the drafting agency and the reviewing agency to focus on reviewing and strengthening the political and legal foundations, and to explain more thoroughly the scope of regulation of the draft Law.

Avoid overlapping and duplication of position and function

In a summary report explaining, accepting and revising some major contents of the draft Law, the Chairman of the National Defense and Security Committee said that regarding the position and function of the force participating in protecting security and order at the grassroots level (Article 2), many opinions suggested to more clearly show the position and function of this force to avoid overlapping with the position and function of the Commune-level Police and some existing forces at the grassroots level. Some opinions suggested to clarify the nature, level and scope of participation in supporting the police force.

The Standing Committee of the National Defense and Security Committee proposed to incorporate into the draft Law as in Articles 2, 3, 4, 5, Chapter II and Section 1, Chapter III the draft Law has incorporated and revised.

Regarding the operating costs and material facilities for the forces participating in protecting security and order at the grassroots level (Article 16), the draft Law inherits the current legal provisions that have been tested in practice. Regarding the source of funding, taking into account the opinions of National Assembly deputies, the Standing Committee of the National Defense and Security Committee has incorporated into the draft Law the following direction: the funding to ensure operations and material facilities for the forces participating in protecting security and order at the grassroots level is guaranteed by the state budget and other legally mobilized financial sources according to the provisions of law.

Some other opinions say that the regulation that in case of local budget difficulties, the Central Government will provide support is inconsistent with the provisions of the State Budget Law because the budget of each level will ensure the spending tasks of that level.

In response to comments from National Assembly deputies, the Standing Committee of the National Defense and Security Committee proposed to remove this provision to ensure consistency with the provisions of the law on the state budget.

Regarding training and support for forces participating in protecting security and order at the grassroots level (Article 20), the Standing Committee of the National Defense and Security Committee clearly stated that the forces participating in protecting security and order at the grassroots level are mass forces that voluntarily participate in the movement of the entire people to protect national security, voluntarily participated by the masses, under the management and with the grassroots government ensuring funding to pay for regimes and policies.

If the "rigid" regulations in the Law on the monthly regular support level and the voluntary social insurance and health insurance support level are not suitable for reality, especially in localities with economic and social difficulties, it may put pressure on the budget for localities that are not yet financially autonomous.

Regarding this content, during the process of completing the Law project, the drafting agency also discussed, asked for opinions and localities agreed to regulate in an open direction as shown in the draft Law.

Therefore, the Standing Committee of the National Defense and Security Committee proposed to regulate in an open direction so that local authorities can decide on the level of regular monthly support, decide on the level of support for voluntary social insurance and health insurance contributions for those participating in the force to protect security and order at the grassroots level to suit the actual conditions in each locality and ensure the feasibility of the Law.

Important significance for security and order at the facility

Commenting at the meeting, National Assembly Chairman Vuong Dinh Hue said that, through comments, the vast majority of delegates agreed with the policy of passing the draft law, with only a few issues needing further clarification regarding the position, functions, tasks, regimes and policies for this force.

The National Assembly Chairman also assessed that this draft Law has important significance for security and order at the grassroots level.

"Far water cannot put out a nearby fire. With the current security and order situation, in the strategy to protect national security, the basis is a very important issue, and some recent incidents have further proven this. Through the opinions of the delegates, the drafting committee has clarified the political and legal basis," the National Assembly Chairman emphasized and requested the National Defense and Security Committee and the drafting agency to study the opinions of the delegates to further perfect the draft law.

Commenting on operating costs, Vice Chairman of the National Assembly Nguyen Duc Hai agreed with the revision of the draft Law in the direction of stipulating that the state budget ensures operating costs for forces participating in protecting security and order at the grassroots level, without distinguishing between central and local budgets in the law, but under the management of the Government.

Regarding the regime, policies for training and support for this force, whether the province can balance it or not, the regime must be the same, and the high or low level can depend on the budget capacity of the locality...

The Vice Chairman of the National Assembly suggested that it is necessary to make specific calculations to estimate and evaluate the impact of policies to train and support this force, in order to ensure that when the force is formed, it is fully and appropriately equipped.

Emphasizing that regulations on support and training regimes are very important and are the basis for ensuring conditions for performing the tasks of this force, Chairman of the Law Committee Hoang Thanh Tung also proposed reviewing and clarifying regulations on regimes and policies for forces participating in protecting security and order at the grassroots level.

Concluding the session, Vice Chairman of the National Assembly Tran Quang Phuong requested the drafting agency and the reviewing agency to coordinate in reviewing and strengthening the political and legal basis, the consistency with Article 46 of the Constitution and to explain more thoroughly the scope of the draft Law.

The Vice Chairman of the National Assembly emphasized that this is a grassroots force established by local authorities and guaranteed by the state budget on the basis of voluntary participation of the people. Therefore, the draft Law needs to clarify the legal status of this force.

Along with that, it is necessary to focus on reviewing the position, functions, tasks and supplementing regulations on authority for this force; having convincing explanations and clear tasks; at the same time, reviewing the criteria for selecting people to participate in the security and order protection force at the grassroots level.

Regarding the budget and guarantee conditions, the Vice Chairman of the National Assembly requested the drafting agency to coordinate with the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Home Affairs to calculate the organization of the payroll and estimate the annual guarantee budget to report specifically to the National Assembly.
