Reporting on a number of important issues regarding the reception, explanation and revision of the draft Law, Chairman of the National Assembly's Committee on Culture and Society Nguyen Dac Vinh said that the Standing Committee of the Committee believes that entities participating in advertising activities must be responsible for providing information when requested by competent state agencies with different information contents, in accordance with the responsibilities of each entity.

Regarding the proposal to add joint liability for compensation, the draft Law has specifically stipulated the rights and obligations of organizations and individuals in the advertising activity chain.

Mr. Nguyen Dac Vinh said that to advertise a product, there are many entities involved and each entity is responsible for fulfilling its obligations when participating in advertising activities. When there is a violation, depending on the nature and extent of the violation, it will be subject to the corresponding form of handling.

In response to the proposal to tighten regulations on influencers who deliver advertising products, in the direction that only those with expertise related to the product can deliver advertising products, the Standing Committee of the Committee stated that in the market mechanism, the participation of celebrities in advertising activities is a commercial activity with positive significance, contributing to promoting production, business, economic development, and encouraging innovation in advertising activities.

"The law on food safety also specifically regulates advertising activities of medical facilities and medical staff... Therefore, the draft law requests to keep the provision of not restricting advertising for influential people," said the Chairman of the National Assembly's Culture and Social Affairs Committee.

Mr. Nguyen Dac Vinh also said that it is necessary to add specific and clear regulations on the rights and obligations of those who deliver advertising products, in order to overcome the situation where some celebrities and influencers advertise falsely, advertise fake and counterfeit goods. In particular, the obligation to "verify the credibility of the advertiser" aims to increase the responsibility of those who deliver advertising products to the community and society.

To ensure feasibility, the Chairman of the Delegation Work Committee suggested that it is necessary to focus on and increase the assignment to the Government of specific and clear responsibilities when incidents occur, responsibilities in the stage of advertising censorship, controlling advertising content on social networking platforms and mass media, as well as strengthening inspection and examination activities for advertising activities in general and advertising in the online environment in particular.

Regarding the addition of implementation guidelines for influential individuals when participating in online advertising in Article 15a and Article 23, Vice Chairman of the National Assembly Le Minh Hoan said that it can be implemented through detailed guidance documents. After the draft Law is passed, management agencies should note to issue specific guidance documents, illustrating typical situations, product verification forms and declaration procedures for influential people, especially on social networks.

According to the Vice Chairman of the National Assembly, the practical reasons for consumer habits and customs in our country are more about word of mouth and product introduction. Meanwhile, many influencers today cannot distinguish the line between product reviews and word of mouth, or sharing experiences, or paid advertising, leading to the risk of violating the law.

Therefore, there is a need for simple, accessible guidance tools to support this target group, in order to both promote an e-commerce advertising channel and minimize violations.

Speaking afterwards, Minister of Culture, Sports and Tourism Nguyen Van Hung said that the Ministry of Culture, Sports and Tourism will closely coordinate with the National Assembly's Committee on Culture and Social Affairs to clarify the contents discussed and commented on by the delegates.

According to the Minister, this draft law only amends and supplements a number of articles, not a comprehensive amendment, and cannot cover all issues, but the drafting agency has tried to include urgent and practical content for handling.

Regarding the need to pay attention and review more carefully the content related to the Commercial Law, Minister Nguyen Van Hung said that he would seriously consider and reconsider. Previously, the Ministry of Culture, Sports and Tourism had worked closely with the Ministry of Industry and Trade and the Ministry of Information and Communications on this content.

"Both ministries agree and have sent documents to the Standing Committee and the National Assembly. We will continue to review and exchange information to ensure that this content does not affect commercial activities in the advertising sector," said Minister Nguyen Van Hung.

Minister Nguyen Van Hung also mentioned the content of "requesting delegates to ban the use of costumes and accessories with business logos" that was raised by National Assembly delegates during the discussion in the hall on May 28 and was reiterated by Chairman of the Delegation Work Committee Nguyen Thanh Hai at the discussion session.

Minister Nguyen Van Hung said that according to the Advertising Law, from a legal and commercial perspective, a delegate wearing a shirt with a brand logo of that company is not considered advertising. Only when there is an agreement or contract between an individual and the brand and there is a material benefit, is it considered advertising.

"Only when there is a commercial element and a media contract, does it become an advertising activity," Minister Nguyen Van Hung emphasized.

The Vice Chairman of the National Assembly requested the National Assembly's Committee on Culture and Society and the Ministry of Culture, Sports and Tourism to continue to coordinate closely so that the Law amending and supplementing a number of articles of the Law on Advertising, when promulgated, will meet the requirements of the country's socio-economic development.
