The case of businesses having difficulty renewing land leases due to red books being "soaked": Khanh Hoa Provincial People's Committee requested an inspection and proposed a solution

Regarding the case of "Businesses find it difficult to extend land leases because their red books are "soaked", on May 22, the People's Committee of Khanh Hoa province issued document No. 6214 to the provincial Civil Judgment Enforcement Department to handle the request of Cam Ranh Seafood Processing and Export Company Limited.

Specifically, Khanh Hoa Provincial People's Committee said that it had received Document No. 040/2025/CRSF and Document No. 041/2025/CRSF dated May 15, 2025 of Cam Ranh Seafood Processing and Export Company Limited, with the following content: Requesting the Khanh Hoa Provincial Civil Judgment Enforcement Department to withdraw and return the original Land Use Right Certificate to Cam Ranh Seafood Processing and Export Company Limited before the province's merger.

Accordingly, the People's Committee of Khanh Hoa province assigned the Department of Civil Judgment Execution of the province to preside over and coordinate with the Department of Agriculture and Environment and relevant agencies, units and localities to inspect and handle the above-mentioned request of Cam Ranh Seafood Processing and Export Company Limited according to its authority and ensure compliance with legal regulations; report and advise on related contents beyond its authority; and report to the Provincial People's Committee on the implementation results before May 30.

As SGGP Newspaper has reported the incident that took place at Cam Ranh Seafood Processing and Export Company Limited (Cam Ranh Seafoods), this enterprise was leased land by the People's Committee of Khanh Hoa province for 20 years (paying land rent annually) to implement the Cam Ranh frozen seafood processing factory project in Cam Thinh Dong commune, Cam Ranh city, the land lease expires in February 2022.

When the land use term was about to expire according to regulations, the company filed a dossier to extend the land use rights but was not resolved by the competent authority because it lacked the original Land Use Rights Certificate (abbreviated as GCN) held by the Bank for Agriculture and Rural Development, Khanh Hoa Branch ( Agribank Khanh Hoa) when Cam Ranh Seafoods mortgaged assets on the land to borrow capital (without mortgaging the GCN).

Regarding the case, the Civil Judgment Enforcement Department of Khanh Hoa province enforced the judgment according to the court's decision on the loan between Cam Ranh Seafoods and Agribank Khanh Hoa. The original certificate has expired and is not collateral for Cam Ranh Seafoods to borrow capital.

Cam Ranh Seafoods repeatedly requested Agribank Khanh Hoa to lend the original certificate to carry out procedures for extending the land lease, but Agribank Khanh Hoa refused. Meanwhile, the Department of Civil Judgment Enforcement of Khanh Hoa province said that extending the right to use leased land does not hinder the attachment and handling of mortgaged assets for enforcement of judgments.

Cam Ranh Seafoods has reported the incident many times to the Provincial Party Committee and People's Committee of Khanh Hoa province, but to date, the land use extension of Cam Ranh Seafoods has not yet been concluded.
