Fake milk powder case: Convergence of all elements of particularly serious economic crime

According to Mr. Tu, this case has all the elements of a particularly serious economic crime: Organized behavior, lasting for many years, targeting vulnerable consumer groups (children, sick people) and achieving illegal revenue of nearly 500 billion VND. More importantly, not only producing and trading in counterfeit food products, the subjects also violated accounting regulations, legalized cash flow, concealed violations, causing widespread damage throughout the financial and tax system.

The incident not only seriously damaged public health but also exposed loopholes in quality control and business operations - risks that could push business leaders into criminal proceedings.

"Legally, this act can be prosecuted under Article 193 of the Penal Code, with the highest sentence being life imprisonment. At the same time, if there is a basis, it can also be prosecuted for tax evasion, accounting violations, and money laundering," said the lawyer.

From the above incident, Mr. Tu also gave advice to businesses: "The law does not wait until a business goes bankrupt or gets into trouble with the law to take effect. Be proactive in creating a solid legal governance foundation - that will help businesses survive."

Previously, VietnamPlus Electronic Newspaper reported that the Ministry of Public Security's Investigation Police Department had dismantled a ring producing, trading, and consuming fake milk powder in extremely large quantities in Hanoi and neighboring provinces.

Authorities prosecuted and temporarily detained the two masterminds of the above-mentioned ring along with six other defendants for the crimes of “Producing and trading in counterfeit food products” and “Violating accounting regulations causing serious consequences”./.
