The Provincial People's Council Legal Committee supervises the implementation of legal provisions in state management of a number of conditional business lines on security and order at the Provincial Police.
In accordance with the provisions of the law on examination, before conducting the examination, the Legal Committee of the Provincial People's Council directed the coordination with the Office of the National Assembly Delegation and the Provincial People's Council to assign a staff and support unit to proactively coordinate with relevant agencies to collect and provide information related to the examination content and transfer necessary documents to members of the committee. In addition, the committee strengthened the survey, grasped the situation, studied documents, and compared the reporting data of the agencies. The examination content focused on issues such as: the authority to issue, consistency with the legal system, conformity with the Party's guidelines and policies and the actual situation and conditions of the province and the feasibility in implementing the resolution.
At the review sessions, the committee always listens to and synthesizes the opinions of delegates and the agencies explaining and clarifying the contents according to the requests of the delegates attending the meeting. From there, the contents are unified to form the basis for building an accurate, high-quality, and highly critical review report. The review report always clearly shows the committee's opinion on the suitability of the draft resolution's content with the local socio -economic development situation and conditions; the constitutionality, legality, and consistency of the draft resolution with the legal system; issues with different opinions and proposes contents that need to be amended, supplemented, and directions for handling those issues. Most of the committee's recommendations are approved by the drafting agencies to edit and supplement the content of reports and submissions before submitting them to the meeting. Through the review work, the committee provides a lot of important information for the Provincial People's Council delegates to discuss at the meetings, serving as a basis for the Provincial People's Council to issue correct and popular resolutions.
Specifically, at the 24th Session of the 18th Provincial People's Council, the Legal Affairs Committee examined 4/36 submissions and draft resolutions submitted at the session, such as: promulgating measures to ensure the implementation of democracy at the grassroots level in Thanh Hoa province; amending Resolution No. 166/2021/NQ-HDND dated October 11, 2021 of the Provincial People's Council regulating the handling of facilities that do not meet fire prevention and fighting requirements in Thanh Hoa province that were put into use before the effective date of the Law on Fire Prevention and Fighting No. 27/2001/QH10; assigning the payroll of Thanh Hoa province in 2025; naming roads, streets and public works in Thieu Hoa town and Hau Hien town, Thieu Hoa district. In the review reports, submissions and draft resolutions, the committee provided the legal basis, the necessity of issuing the resolution, commented on the feasibility of the resolution and proposed the Provincial People's Council to pass the resolution.
Along with the work of reviewing reports and draft resolutions, the Provincial People's Council's Legal Committee has performed its tasks in regular and thematic supervision activities. The supervision work at the grassroots level is selected, focused, limiting overlap in time and location of supervision, not affecting the activities of the agencies and units under supervision. Through supervision, the Provincial People's Council's Legal Committee has assessed the advantages, pointed out the shortcomings and limitations in the leadership and management of the State in the fields of inspection, justice, internal affairs... and oriented to timely remedies. During the supervision process, the committee has promoted the role and responsibility of the specialized agency of the Provincial People's Council, delved into and grasped the issues thoroughly, especially issues affecting the lives and production of the people, thereby reflecting in the review report presented at the session.
To ensure increasingly high-quality and effective audit activities, the Legal Department continues to strictly implement audit processes and procedures. Strengthen coordination with the Provincial People's Committee and relevant agencies, ensuring the submission of draft reports, submissions, and resolutions within the prescribed time so that members have enough time to research and study as a basis for building audit reports to ensure quality. Promote the sense of responsibility of each member in researching and collecting information on contents related to the audit field.
