
According to the Ministry of Home Affairs, Decree No. 29/2024/ND-CP of the Government has created a legal basis for the development and standardization of standards for leadership and management positions in state administrative agencies, contributing to improving the quality of the team, building a clean, professional, modern administration serving the people.
Implementing the Party's policy on streamlining the apparatus, rearranging administrative units and building a two-level local government model, along with the Politburo and the Secretariat issuing new regulations on personnel work, a number of regulations in Decree 29/2024/ND-CP have become inappropriate. Therefore, it is necessary to develop and issue a new Decree to replace them according to simplified procedures to ensure consistency, synchronization and improve the quality and efficiency of the team of civil servants, leaders and managers in state administrative agencies.
The issuance of the Decree ensures a full legal basis, consistency and synchronization with the Party's and the National Assembly's regulations on personnel work and the structure and organization of ministries, ministerial-level agencies, government agencies and two-level local authorities.
The Draft Decree consists of 05 chapters and 32 articles regulating the standards for titles and positions of civil servants, leaders and managers in state administrative agencies (except for special forces such as national defense, police and cryptography, which are implemented according to regulations of competent authorities). Specifically:
Chapter I: General provisions include 04 articles (from Article 1 to Article 4) regulating the scope of regulation; applicable subjects in administrative organizations; public service units; implementation principles.
Chapter II: General standards for titles and positions of civil servants, leaders and managers include 07 articles (from Article 5 to Article 11) stipulating standards on politics, ideology; moral qualities, lifestyle and sense of organization and discipline; qualifications, capacity; prestige and ability to gather and unite; achievements and work results; health, age, work experience and some special cases applying title and position standards when appointing.
Chapter III: Standards for titles and positions of civil servants in leadership and management include 15 articles (from Article 12 to Article 26) stipulating standards for the following titles: Deputy Minister; Department Head and equivalent; Deputy Department Head and equivalent; Head of Department and equivalent of the Ministry; Deputy Head of Department and equivalent of the Ministry; Head of Department and equivalent of the Sub-Department under the Department; Deputy Head of Department and equivalent of the Sub-Department under the Department; Director of Department and equivalent; Deputy Director of Department and equivalent; Head of Department and equivalent of the Department; Deputy Head of Department and equivalent of the Department; Head of Department and equivalent of the Sub-Department under the Department; Deputy Head of Department and equivalent of the Department; Head of Department and equivalent of the Department; Deputy Head of Department and equivalent of the Sub-Department under the Department; Head of Department and equivalent of the commune-level; Deputy Head of Department and equivalent of the commune-level.
Chapter IV: Standards for titles and positions of management officials includes 03 articles (from Article 27 to Article 29) stipulating standards for heads and deputy heads of Government agencies, Director of Hanoi National University, Director of Ho Chi Minh City National University; titles and positions of management officials of public service units under Ministries, Government agencies, Hanoi National University, Ho Chi Minh City National University, public service units under the People's Committees of provinces, Departments, Branches under Departments and People's Committees of communes.
Chapter V: Implementation provisions include 03 articles (from Article 30 to Article 32) regulating implementation organization, transitional provisions, and implementation provisions.
Proposal to abolish some ministerial-level positions and titles
The Draft Decree has a number of new points compared to Decree 29/2024/ND-CP as follows:
Regarding the subjects of application in administrative organizations, in the group of ministerial-level titles and positions, the draft Decree proposes to remove the leadership and management titles of the General Department; the title standards of the State Capital Management Committee at enterprises according to Plan No. 141/KH-BCĐTKNQ18 and the Decrees stipulating the functions, tasks, powers and organizational structure of the Ministries and ministerial-level agencies. Remove the standards for the titles of Chief Inspector, Deputy Chief Inspector of the Ministry; Chief Inspector of the Department, Deputy Chief Inspector of the Department according to the provisions of the Inspection Law 2025. At the same time, add the titles and positions of Head and Deputy Head of the regional agency under the Department under the Ministry.
In addition, the draft Decree supplements titles and positions in commune-level administrative organizations, including: Chief of Office of the People's Council and People's Committee, Head of Department of the People's Committee at commune level; Deputy Chief of Office of the People's Council and People's Committee, Deputy Head of Department of the People's Committee at commune level.
Proposal to add applicable subjects in public service units
Based on the list of positions, groups of positions, leadership positions in Regulation No. 368-QD/TW, on the basis of position allowance coefficient, management level... the draft Decree stipulates the groups of subjects applicable in public service units as follows:
1. Heads and deputy heads of Government agencies;
2. Heads and deputy heads of public service units under Government agencies;
3. Director of Hanoi National University, Director of Ho Chi Minh City National University;
4. Heads and deputy heads of public service units under the Ministry;
5. Heads and deputy heads of public service units under the People's Committees of provincial level;
6. Heads and deputy heads of public service units under the Department;
7. Heads and deputy heads of public service units under the Department's Branches;
8. Heads and deputy heads of public service units under the People's Committees at the commune level.
The Draft Decree also stipulates standards on political qualifications and state management for titles and positions of civil servants, leaders and managers as follows:
Regarding political theory level, the draft proposes to stipulate:
Bachelor's degree in politics or advanced political theory or advanced political-administrative theory or certified equivalent to advanced political theory by a competent authority applicable to positions and positions such as: Deputy Minister, Department Head and equivalent, Deputy Department Head and equivalent, Department Director and equivalent, head and deputy head of government agencies; head and deputy head of public service units under government agencies; Director of Hanoi National University, Director of Ho Chi Minh City National University; head and deputy head of public service units under the Ministry; head of public service units under the People's Committee of the provincial level.
Graduated from intermediate level of political theory or higher or intermediate level of political theory - administration or certified equivalent to intermediate level of political theory by competent authority applicable to titles and positions such as: Head of Department and equivalent of Ministry; Deputy Head of Department and equivalent of Ministry; Head of Department and equivalent of Branch, of regional agency under Department; Deputy Director of Department and equivalent; Head of Department and equivalent of Department; Deputy Head of Department and equivalent of Department; Head of Department and equivalent of Branch under Department.
At the same time, political theory qualifications are not required for titles and positions such as: Deputy Head of Department and equivalent of Sub-Department, of regional agency under the Department; Deputy Head of Department and equivalent of Sub-Department under Department; Deputy Head of Department and equivalent of commune level.
Regarding the level of state management: based on the Law on Cadres and Civil Servants 2025, the Law on Public Employees 2025, the draft does not stipulate the standard of having a training certificate according to the standards of professional ranks and titles for leadership and management positions. The draft stipulates principles such as: Meeting the standards of professional qualifications, science, technology, information technology, foreign languages appropriate to the leadership and management positions according to the regulations of competent authorities.
