The Cohen's d test has been used by DOC in antidumping investigations for more than 10 years. However, recently, the Court of Appeals for the Federal Circuit ruled that DOC's use of this test was unreasonable because it was not based on a large enough database and did not satisfy the statistical assumptions of normal distribution and equal variance. Therefore, DOC organized a public comment period on the alternative to the use of the above Cohen's d test.
The deadline for receiving comments from all interested organizations and individuals is before May 30, 2025, through the following methods:
+ Electronic: Access the Federal Lawmaking Electronic Information Portal at: https://www.regulations.gov, enter the code ITA-2025-0004 in the Search section. Click on the “Comment” icon, fill in the required information fields and enter/attach a comment, or
