Agencies, organizations and localities finish collecting opinions on the draft Resolution amending the 2013 Constitution.

(Chinhphu.vn) - Today (May 30) is the day that agencies, organizations, and localities finish collecting public opinions at their agencies, organizations, and localities on the Draft Resolution amending and supplementing a number of articles of the 2013 Constitution.

Statistics from the Ministry of Justice show that, as of 12:00 on May 30, 2025, the Ministry of Justice received 51 reports from: the Central Policy and Strategy Committee; the Supreme People's Procuracy ; the Central Committee of the Vietnam Fatherland Front; 16/22 ministries, ministerial-level agencies, and government agencies; 32/63 People's Committees of provinces and centrally run cities.

Regarding the results of collecting opinions on the VNeID application, from May 6, 2025 to 24:00 on May 29, 2025, the total number of people participating in giving opinions on this application is about 20 million people (currently, the Ministry of Public Security is compiling accurate data from the People's Opinion Collection Utility on the VNeID application).

Regarding the status of drafting the Report synthesizing public opinions, sectors and levels on the draft Resolution, Ms. Nguyen Thi Hanh, Director of the Department of Criminal and Administrative Law, Ministry of Justice said: The report synthesizing the results of collecting public opinions, sectors and levels on the draft Resolution will be built on the basis of synthesizing reports on the results of collecting opinions from agencies, ministries, sectors and localities; reports on the results of collecting opinions on the VNeID application, the National Assembly Electronic Information Portal, and the Government Electronic Information Portal.

Currently, the Ministry of Justice is synthesizing reports sent by agencies, ministries, branches and localities. Because there are not yet complete reports, the data is continuing to be updated.

About the synthesis method: According to Section II.3 of Plan No. 05/KH-UBDTSĐBSHP dated May 5, 2025 of the Drafting Committee for Amendments and Supplements to a Number of Articles of the 2013 Constitution: Individuals can give their opinions directly on the VNeID application, the National Assembly Electronic Information Portal, the Government Electronic Information Portal, or send their opinions in writing to the agencies responsible for synthesizing people's opinions stated in Section III of this Plan.

Agencies and organizations, according to their functions, tasks, powers, progress requirements, and actual situations of their agencies, organizations, and localities, shall proactively plan to organize conferences, seminars, and discussions to collect opinions from subjects under their management, experts, and scientists. Local authorities at all levels shall organize to collect public opinions in forms appropriate to practical conditions in accordance with the provisions of law on implementing democracy at the grassroots level.

In practice, each individual can contribute to the content of the draft Resolution through different forms (for example, both contributing on the VNeID application and in writing when the local government organizes the distribution of opinion forms, etc.). Therefore, in order to fully and accurately reflect the results of the opinion collection as well as the participation of people and agencies and organizations in the opinion collection process, the Ministry of Justice conducts the synthesis according to turn of opinion

Each written comment from an agency, organization or individual is counted as 01 comment (not counting comments made at conferences, seminars or forums); each individual commenting on the VNeID application is counted as 01 comment; each organization or individual commenting on the National Assembly Electronic Information Portal/Government Electronic Information Portal is counted as 01 comment.

The Ministry of Justice will compile the number of comments on: Each amendment and supplement to the draft Resolution (including the amendment and supplement to Article 9, Article 10, Clause 1, Article 84, Article 110, Clause 2, Article 111, Clause 2, Article 112, Clause 1, Article 114, Clause 2, Article 115 of the 2013 Constitution); constitutional techniques; Article 2 of the draft Resolution and other contents (if any), closely following the requirements in Section IV.2 of Plan No. 05/KH-UBDTSĐBSHP.

In fact, agencies, organizations and individuals can comment on one, some or all of the contents of the draft Resolution; they can or cannot comment on constitutional techniques and other contents. Therefore, the number of comments on each content of the draft Resolution is different. For example, there are contents that receive many comments from agencies, organizations and individuals such as the content of amending and supplementing Article 9, Article 110, etc.

In Section IV.2 of Plan No. 05/KH-UBDTSĐBSHP, the Drafting Committee for amending and supplementing a number of articles of the 2013 Constitution requires: Synthesizing specific comments on each content, article, and clause of the draft Resolution, clearly stating the number of opinions in favor or against and the reasons.

On that basis, the Ministry of Justice has provided guidance on the outline of the report summarizing the results of the consultation and the attached appendix, requiring agencies, ministries, branches and localities to clearly state the total number of comments, including the number of comments from agencies, organizations and the number of comments from individuals; the number of comments in favor or the number of comments against and the reasons.

Regarding the issues arising in the process of synthesizing and developing the Report, Director of the Department of Criminal and Administrative Law Nguyen Thi Hanh said that through reviewing the reports of agencies, ministries, branches and localities sent to the Ministry of Justice, the Ministry of Justice found that the majority of agencies performed the synthesis and statistical data completely and accurately, ensuring consistency with the general instructions of the Ministry of Justice, clearly stating the number of opinions in favor or disapproval and the reasons, facilitating the general synthesis...

According to Ms. Nguyen Thi Hanh, by June 1, 2025 at the latest, the Ministry of Justice will complete the synthesis of the results of collecting opinions from the people, sectors and levels on the draft Resolution. By June 3, 2025 at the latest, the Ministry of Justice will submit to the Government a draft Report. By June 5, 2025 at the latest, the Government will submit to the Drafting Committee a proposal to amend and supplement a number of articles of the 2013 Constitution.
