The Law on Road Traffic Order and Safety has just been passed by the 15th National Assembly, effective from January 1, 2025, which details the conditions for drivers participating in road traffic.
Accordingly, drivers participating in road traffic must be of age and in good health as prescribed by law; have a valid driving license with points remaining, appropriate to the type of vehicle being driven, issued by a competent authority, except for motorbike drivers specified in Clause 4 of this Article.
When participating in road traffic, drivers must carry documents such as vehicle registration certificate or a certified copy of the vehicle registration certificate with the original valid confirmation document from a credit institution in case the vehicle is mortgaged at a credit institution or foreign bank branch.
Next, you must bring a driver's license appropriate to the type of vehicle you are driving; a certificate of technical safety and environmental protection inspection for motor vehicles and smart vehicles as prescribed by law; a certificate of compulsory civil liability insurance for motor vehicle owners.
Drivers of specialized motorbikes participating in road traffic must be of age and in good health as prescribed by law; have a license or certificate to operate specialized motorbikes appropriate to the type of specialized motorbike being driven; have a driving license or a certificate of training in road traffic law.
In case it has been integrated into the electronic identification account, presentation and checking can be done through the electronic identification account.
Motorcyclists participating in road traffic must understand road traffic rules, have vehicle control skills, and meet the age and health requirements as prescribed in Point a, Clause 1 and Clause 2, Article 59 of this Law.
Learners and test takers must practice driving on a practice car or test car on a practice road or test route, with a driving instructor or test examiner as their driving guarantor. Driving instructors and test examiners must carry the above-mentioned documents.
The new law also has a provision regulating the age and health of drivers participating in road traffic.
According to Article 59, people aged 16 and over are allowed to drive motorbikes; people aged 18 and over are granted driving licenses of classes A1, A, B1, B, C1, and are granted certificates of training in road traffic law to drive specialized motorbikes on the road.
People aged 21 and over are granted driving licenses of class C, BE; people aged 24 and over are granted driving licenses of class D1, D2, C1E, CE; people aged 27 and over are granted driving licenses of class D, D1E, D2E, DE.
The maximum age for drivers of sleeper cars is 57 years old for men and 55 years old for women.
Drivers of vehicles participating in road traffic must ensure health conditions appropriate to each type of vehicle they are allowed to drive.
The Minister of Health shall prescribe health standards and health examinations for drivers and operators of specialized motorbikes; periodic health examinations for car drivers; and establish a database on the health of drivers and operators of specialized motorbikes.
The Minister of National Defense and the Minister of Public Security shall prescribe the age of drivers in the military and police forces performing defense and security duties.
