When the citizen ID card expires, do I have to immediately change it to an ID card?

Question: My citizen ID card will expire at the end of April 2024. Do I have to change it to an ID card immediately?

On November 27, 2023, the National Assembly passed the draft Law on Identification (effective from July 1, 2024). With the name change from the Law on Citizen Identification to the Law on Identification, the Citizen Identification Card will also have a new name, the Identification Card.

Article 46 of the Law on Identification stipulates on transition clearly: Citizen Identification Cards issued before the effective date of this Law (July 1, 2024) are valid until the expiration date printed on the card. Citizens, when in need, will be issued a replacement ID card.

If the ID card is still valid, it can be used until December 31, 2024.

Legal documents that have been issued using information from the ID card or Citizen Identification Card shall retain their validity; state agencies shall not require citizens to change or adjust information on the ID card or Citizen Identification Card in the issued documents.

Citizen Identification Cards and Identity Cards that expire from January 15, 2024 to before June 30, 2024 will continue to be valid until June 30, 2024.

Regulations on the use of Citizen Identification Cards and Identity Cards in legal documents issued before the effective date of this Law shall be applied as for identity cards issued under the provisions of this Law.

Thus, citizen identification cards that expire from January 15, 2024 to before June 30, 2024 will continue to be valid until June 30, 2024 according to the above regulations.

Notes on ID cards recommended by the police

To prevent criminals from stealing personal information from ID cards to commit crimes, the police have issued recommendations to the public.

Accordingly, people absolutely must not lend, photograph, or pawn their ID cards/Citizen ID cards with electronic chips to lending companies operating "black credit";

Absolutely do not post or share images of ID cards/Citizen ID cards with chips on social networking sites such as Facebook, Zalo...

In addition, authorities also pay attention to people in some cases.

When losing an ID card, people must immediately report it to the authorities or go to the card issuance points where they registered their permanent or temporary residence to be guided on the procedures for reissuing a new card. This is the basis for verifying that the ID card owner during the time of loss was not involved in any civil transactions or committed any illegal acts;

When being scammed by bad guys to steal personal information of ID cards to commit illegal acts, people need to immediately contact the nearest police agency for support.

In case of suspicion or discovery of the ID card number of the individual who opened the bank account..., immediately notify the bank to block the violating account;

In case an individual discovers the leasing of an ID card or Citizen ID card, he/she must immediately report the violation to the nearest police agency and provide documents related to the leasing or borrowing of the ID card/Citizen ID card for handling according to regulations.

If you know that someone is using another person's ID card/Citizen ID card to open an account and use it for illegal activities without reporting it, you may be prosecuted according to the law depending on whether the violation is less serious, serious, very serious or extremely serious to have a basis for handling.
