NDO - Urgently implementing the arrangement and streamlining of the apparatus according to the guidance and direction of the Central Government, by the end of February 2025, Dien Bien province had completed the merger of departments and branches and adjusted the number of civil servants in the agencies of the People's Council, People's Committee at the provincial and district levels in the area. However, in practice, Dien Bien province has found many difficulties in determining subjects and resolving early retirement policies for cadres and civil servants who have worked for 15 years in particularly difficult areas (or commonly known as areas with regional allowances of 0.7).

Referring to specific difficulties in resolving the regime for cadres and civil servants who retire before the retirement age and have worked in particularly difficult areas (allowance 0.7) in Dien Bien, comrade Pham Khac Quan, member of the Standing Committee, Head of the Organization Committee of Dien Bien Provincial Party Committee, said that Dien Bien is currently implementing the provisions of Decree No. 177/ND-CP dated December 31, 2024 of the Government on regimes and policies for cases of non-re-election, re-appointment and cadres who resign or retire at will; Decree No. 178/2024/ND-CP dated December 31, 2024 on policies and regimes for cadres, civil servants, public employees and armed forces in implementing the organization of the political system; Circular No. 01/2025/TT-BNV, dated January 17, 2025 of the Ministry of Home Affairs guiding the implementation of policies and regimes for cadres, civil servants, public employees and workers in the implementation of the organizational arrangement of the political system, but found it very difficult and problematic to identify subjects and apply policies.

Comrade Pham Khac Quan stated that according to Article 169, Clause 1, Article 219 of the 2019 Labor Code and Decree No. 135/2020/ND-CP dated November 18, 2020 of the Government, employees who have worked for 15 years or more in places with a regional allowance of 0.7 or more can retire 5 years earlier. According to this regulation, Dien Bien province has many officials and civil servants at the district level in areas with a regional allowance coefficient of 0.7 (including Tua Chua, Dien Bien Dong, Muong Nhe, Nam Po) who are eligible to retire (retire at a lower age, in Appendix II of Decree No. 135/ND-CP).

However, in reality, most individuals in this area do not wish to retire at a lower age, so agencies and units continue to arrange jobs for officials and civil servants to work until they reach the normal retirement age (stipulated in Appendix I - Decree No. 135/2020/ND-CP).

When implementing the regime for cadres according to Decree 177/2024/ND-CP, Dien Bien province found that Decree 177 has not clearly stipulated whether cadres working in areas with a coefficient of 0.7 (difficult areas) who do not retire at a lower age (stipulated in Appendix II, Decree 135/2020/ND-CP) are eligible for the regime and policies in Decree 177/2024/ND-CP or not.

Similarly, the settlement of policies for cadres and civil servants who have worked for 15 years or more in disadvantaged areas (allowance 0.7) and wish to retire according to the provisions of Decree 178/2024/ND-CP in Dien Bien is currently very difficult.

Take the case of comrade Dang Xuan Vinh, former Standing Deputy Secretary of the Party Committee of agencies and enterprises of Dien Bien province, who was awarded Decision 6025-QD/TU on February 17, 2025 by the Standing Committee of the Provincial Party Committee to retire early to enjoy social insurance and support according to the provisions of Decree 178, but then on March 28, 2025, the Standing Committee of the Provincial Party Committee issued a decision to cancel the retirement decision and transfer work for comrade Dang Xuan Vinh.

Comrade Tran Quoc Cuong, member of the Party Central Committee, Secretary of Dien Bien Provincial Party Committee, spoke at the Conference to announce decisions on early retirement for cadres organized by Dien Bien Provincial Party Committee on the afternoon of February 12, 2025.

"Comrade Dang Xuan Vinh is one of the officials and leaders holding key positions at the provincial department and branch levels who took the lead in retiring early according to Decree 178 to facilitate the locality in implementing the arrangement and streamlining of the apparatus. However, according to the provisions of Appendix II, Decree No. 135/2020/ND-CP of the Government, Comrade Vinh is eligible for retirement at the right age (he has 17 years and 8 months of work in an area with an allowance coefficient of 0.7) and is not entitled to benefits according to the provisions of Decree 178, so Comrade Vinh expressed his wish to continue working and was approved by the Provincial Party Committee," Comrade Pham Khac Quan stated.

From the specific case of comrade Dang Xuan Vinh, the Organizing Committee of Dien Bien Provincial Party Committee reviewed and grasped the thoughts and aspirations of cadres and civil servants who have been working in areas with an allowance coefficient of 0.7 and found that the settlement according to Decree 178 for cadres in these districts is really very difficult.

Citing the case of comrade Dang Xuan Vinh, comrade Pham Khac Quan stated that if following Appendix I, Decree 135/2020/ND-CP, comrade Vinh would be able to retire and receive a subsidy of about 1.5 billion VND; but if following Appendix II, Decree 135/2020/ND-CP, comrade Vinh would only be able to retire and not receive a subsidy.

Thus, looking at the two methods of application as analyzed above, it is clear that applying according to which appendix is more superior for individual cadres and more convenient for the organization when implementing the arrangement and streamlining of the apparatus. Furthermore, if we compare the case of Comrade Vinh with cadres of the same age and same years of work in favorable areas who wish to retire early according to Decree 178, we can see even more clearly the inadequacy of applying the regime to cadres in difficult areas.

To ensure that the implementation of policies for cadres who wish to retire early is accurate, complete, convenient and consistent, the Dien Bien Provincial Party Committee has requested the Central Organizing Committee and the Ministry of Home Affairs to provide more specific and clear instructions in the direction of expanding and clarifying the subjects in Decree 178/2024/ND-CP and Decree 67/2025/ND-CP dated March 25, 2025 amending and supplementing a number of articles of Decree 178.

Comrade Pham Khac Quan said that in order to facilitate the locality and encourage cadres, civil servants, public employees, and workers who have worked in disadvantaged areas for 15 years or more (allowance 0.7) to voluntarily retire early, he proposed that the Central Government open the regulation by allowing workers to choose to retire early according to Appendix I or Appendix II, Decree 135/2020/ND-CP.
