Need to unify the legal corridor on digital transformation

Continuing the 10th session of the 15th National Assembly, on the afternoon of November 6, at the group discussion session on the projects: Law on Digital Transformation, Law on High Technology (amended), Law on amending and supplementing a number of articles of the Law on Technology Transfer, delegates focused on analyzing and pointing out many issues that need to be reviewed to ensure the consistency, feasibility and synchronization of the legal system.

Avoid "law on law" situation

Agreeing on the need to promulgate the Law on Digital Transformation, delegates emphasized that practice shows that the current legal framework is scattered across many specialized laws (Digital Technology Industry, Data, Electronic Transactions, Telecommunications, Network Information Security, Cyber ​​Security)... Many new issues have not been legalized such as digitizing the real world, connecting the real world - digital world, digital language, sovereignty in cyberspace, rights and obligations of citizens in the digital environment. The promulgation of the Law on Digital Transformation needs to unify the legal framework, eliminate overlaps, establish an inter-sectoral coordination mechanism, create momentum for the digital government, digital economy, digital society, improve competitiveness and safety, and order in the digital space.

Delegate Le Thu Ha (Lao Cai) said that the current draft Law is too broad in scope, covering digital government, digital economy and digital society. Although this approach is comprehensive, it can easily lead to a situation of "overlapping laws" with other specialized laws.

To overcome this situation, delegate Le Thu Ha proposed clearly establishing the role of the Law on Digital Transformation as a "framework law, basic law", to shape the institutional structure, principles, rights and common responsibilities on digital transformation; connecting and leading specialized fields, creating consistency in the entire digital legal system.

“The scope of regulation should focus on the public sector and the political system (digital transformation in state administration, public service provision, interaction between the State and people and businesses). The digital economic and social sector should be encouraged to develop according to an open policy mechanism and gradually adjusted by other specialized laws,” the delegate emphasized.

Delegate Le Thu Ha proposed to amend the law to regulate digital transformation in the political system and the operations of state agencies. The State encourages organizations, businesses, and individuals to carry out digital transformation in production, business, and social life in accordance with legal regulations.

“Digital transformation is not just about digitizing data but also about the process of comprehensively restructuring the operations of agencies, organizations, businesses and individuals based on data and digital technology. If this definition is institutionalized in the draft, the Law will become a benchmark for unifying concepts for other legal documents,” the delegate suggested.

Also giving opinions on the draft law, some delegates said that the "ground" of digital transformation in our country is currently uneven, especially in localities with difficult economic conditions, where digital transformation is very difficult. Therefore, delegates hope that the Law on Digital Transformation must outline policies to attract investment projects, especially investment projects to develop infrastructure to serve digital transformation for localities with socio-economic difficulties.

Ensuring inclusiveness in science and technology development

Discussing the draft Law on Technology Transfer (amended) and the Law on High Technology (amended), delegates said that amending the law is considered an inevitable step to meet the requirements of strong development of science, technology and innovation in the context of digital economy and deep international integration.

Discussing in groups, delegate Quàng Văn Hương (Sơn La) emphasized the need to ensure consistency and maintain priority policies for rural, mountainous, island and areas with difficult socio-economic conditions. The delegate proposed adding the content of "narrowing the development gap between regions" to the criteria for determining strategic technology, to ensure inclusiveness in science and technology development. It is recommended to expand the scope of application of high technology to remote, border and island areas, in line with the goal of balanced and sustainable development.

Delegates also proposed to supplement regulations on priority areas and unify the Law on Technology Transfer, the Law on Investment and the Law on Science, Technology and Innovation to avoid conflicts in implementation. In addition, delegates proposed to maintain preferential policies on investment, resources and innovation funds for disadvantaged areas, considering this as a tool to promote sustainable development and narrow the gap between regions.

Regarding the draft Law on High Technology (amended), delegate Nguyen Van Huy (Hung Yen) said that this draft Law not only inherits the regulations that are still suitable, but also adds many new breakthrough points, aiming at the goal of building a transparent legal corridor, encouraging investment, research, transfer and application of high technology in all areas of the economy.

According to the delegate, in addition to economic criteria, the list of strategic technology criteria (Article 5) needs to add the criterion of "ensuring national defense and security, data sovereignty". The delegate proposed adding the criterion of "level of technological autonomy" and regulating the "update cycle" of the technology list.
