The international workshop "Building a creative economy : Promoting the enforcement of copyright in Vietnam" organized by the International Federation of Copyright Organizations (IFRRO), the Vietnam Copyright Association (VIETRRO), the Copyright Office - Ministry of Culture, Sports and Tourism, the Vietnam Publishing Association, and the Ho Chi Minh City Education and Training Association, recently took place in Ho Chi Minh City.
The workshop continues the journey of promoting social and community awareness of copyright and enforcement of copyright rights in Vietnam organized by the Vietnam Copyright Association, the Institute of Development Philosophy, the Institute of Development Issues and the Minh Duc Institute of Intellectual Property Management from 2024.
Speaking at the workshop, international delegates pointed out that, in the context of deep global integration as today, Vietnam, represented by VIETRRO, needs to strengthen its connection with the WIPO Connect platform of the World Intellectual Property Organization (WIPO) to more effectively implement the enforcement of its Intellectual Property Law. WIPO Connect is a system for digitizing and managing creative works, supporting authors in establishing ownership, protecting and exploiting works in the international digital environment.

World experts all affirm that licensing copying for the use and exploitation of works is the most effective copyright management method, both ensuring fairness for creators and creating conditions for access to legal knowledge for society; at the same time, it is proposed that instead of focusing on handling violations, Vietnam should strongly communicate about the behavior of legal use of works, and at the same time, incorporate the copy licensing mechanism into the country's cultural, educational , scientific and technological policies, and in the near future, it can be piloted in the school system.
Representatives of the world's leading copyright organizations also shared many experiences related to licensing for copying in the system of universities, research institutes, and businesses (Copyright Clearance Center (CCC) of the United States), operating a collective licensing system for public agencies, schools, and libraries to help reduce copyright management costs by more than 70% (Copyright Licensing Agency (CLA) of the UK), licensing for the entire education system, more than 40,000 authors and publishers, earning hundreds of millions of AUD each year (Copyright Agency Australia (CAA) of Australia).
Mr. Hoang Trong Quang - Chairman of the Vietnam Copyright Association (VIETRRO) affirmed: "Enforcing copyright is not only to protect the rights of creators, but also a prerequisite to promote the circulation of legal knowledge, nurture creativity and build a culture that respects intellectual values."
Director of the Law and Copyright Center (LECOCE) Le Thi Minh Hang of the Vietnam Copyright Association, delves into the story of enforcing the right to copy from the method of "legal access to works". According to Ms. Hang, the legal licensing of the right to copy works has been the biggest bottleneck in Vietnam's implementation of the Intellectual Property Law over the past time. In practice, in addition to granting copyright and exclusive patent rights to authors in general, currently in the implementation of the Intellectual Property Law, we have not defined the concept of what a legal user is, so that we can have a basis to handle violations. It is necessary to create a corridor for users to access and use works legally through the mechanism of licensing the right to copy.
Based on the recommendations of experts, VIETRRO and LECOCE have launched the "Legal Education Licensing" pilot program, expected to be deployed in the first 10 schools nationwide, in coordination with the hocdoc.vn platform to develop a reading culture, use legal learning materials and pay appropriate copyright remuneration to authors and publishers. The program is expected to become a model for libraries, schools and educational institutions, contributing to standardizing the process of digitizing, accessing and copying legal documents in accordance with the spirit of the Law on Intellectual Property and Decree 17/2023/ND-CP dated April 26, 2023 of the Government detailing a number of articles and measures to implement the Law on Intellectual Property on copyright and related rights./.
