The Government proposes to delegate the power to recruit, mobilize, and transfer teachers, managers, and staff in public preschool, general education , and continuing education institutions to the directors of the Department of Education and Training.
On the morning of November 17, Minister of Justice Nguyen Hai Ninh presented a draft Resolution of the National Assembly on a number of specific and outstanding mechanisms and policies to make breakthroughs in the development of education and training .

Overcoming the local surplus and shortage of teachers
According to the submission, one of the breakthrough policies proposed in the draft resolution is to delegate the power to recruit, receive, mobilize, transfer, and second teachers, managers, and staff in public preschool, general education, and continuing education institutions to the director of the Department of Education and Training, instead of the chairman of the provincial People's Committee as currently.
The Government said that the above regulation clearly demonstrates the spirit of promoting decentralization, delegation of power, and authorization in state management.
Practice over the past years has shown that decentralizing recruitment and assignment authority to the People's Committees at the district level has led to "fragmentation" in staff management, causing local surplus and shortage of teachers among districts.
Not to mention, because the education sector is not in charge of recruitment, the recruitment exam often uses the same test as for civil servants in other sectors, which does not evaluate the pedagogical capacity and specific professional qualities of the candidates.
This directly affects the quality of the teaching staff, especially in the context of implementing the new general education program.
If we continue to let the commune level preside over the recruitment according to some proposals, it will be even more unfeasible, because the commune level does not have a specialized education agency and does not have the conditions to organize the recruitment exam and evaluate the candidates' capacity.
Therefore, decentralization and authorization to the Director of the Department of Education and Training will help ensure consistency and synchronization in the recruitment, mobilization, secondment and use of teaching staff; overcome the local gap and shortage between localities...
The draft resolution also stipulates a mechanism to ensure comprehensive autonomy for higher education and vocational education institutions; and to organize the unified use of a set of textbooks nationwide.
Along with that is developing a smart education platform and a national database on education; promoting cooperation between the State - schools - businesses; mechanisms to attract and use foreign experts and scientists; stipulating the proportion of state budget expenditure for education to reach at least 20% of total expenditure...

Need a monitoring mechanism to avoid negativity
Examining the above content, the Committee on Culture and Society acknowledged the proactiveness, positivity and close coordination of the drafting agency in promptly receiving, explaining, revising and updating the draft resolution.
However, many specific mechanisms and policies require large resources to implement, such as: preferential vocational allowances with a minimum level of 70% for teachers and 30% for staff; free provision of textbooks; free tuition and curriculum for national defense and security education; credit support, scholarships for doctoral training...
The drafting agency recommends carefully assessing the impact, especially in terms of financial resources, to ensure feasibility.
The Committee on Culture and Society also noted the regulation that the Director of the Department of Education and Training has the authority to mobilize, transfer, second, arrange, assign, and change job positions for teachers, educational institution managers, and staff in public educational institutions related to the scope of 2 or more commune-level administrative units.
According to the inspection agency, the above regulation is not strict, it can be understood that "2 communes" are in the same province or belong to 2 provinces; and the director of the Department of Education and Training of a province cannot exercise this authority over educational personnel of a locality belonging to another province.
Therefore, it is recommended to consider adjusting and clearly regulating the direction between commune-level administrative units in the same province.
The inspection agency also recommended considering specific regulations on monitoring, inspection, and periodic reporting mechanisms to ensure transparency and fairness in recruitment, mobilization, and transfer of educational personnel, avoiding the risk of negativity and localism.
Continue to research and regulate decentralization and authorization for public educational institutions in the province that meet the conditions and capacity to implement regulations to recruit and receive educational personnel.
