Proposed regulations on the sale of national reserve goods for national defense and security

On November 17, the National Assembly heard the presentation and examination report on the draft Law on National Reserves (amended).

Presenting the Government 's report, Minister of Finance Nguyen Van Thang said that the draft law has decentralized the decision-making authority to the Minister of Finance and ministers and heads of ministerial-level agencies and has clearly defined the authority of the Minister of Finance (state management of national reserves) with the Minister and heads of ministerial-level agencies.

The draft law also assigned the Government to specify this content in detail and to prescribe the content and procedures for deciding on the import and export of national reserve goods.

Regarding the provisions on the purchase and sale of national reserve goods (Article 21), the draft law does not re-prescribe and implements the application of existing laws. The Government regulates the authority and procedures for the purchase and sale of national reserve goods according to the method of "Direct purchase and sale of national reserve goods widely to all subjects; designated sale".

At the same time, clearly stipulate the content "Purchase and sale of national reserve goods managed by the Ministry of National Defense and the Ministry of Public Security shall be applied according to the provisions of law on the field of national defense and security and relevant laws" and "National reserve goods serving national defense and security shall only be sold by designation to the field of national defense and security, including enterprises directly serving national defense and security for production".

To have enough time for the Government and ministries and ministerial-level agencies to issue sufficient guiding documents, it is proposed that the Law on National Reserves (amended) take effect from July 1, 2026.

Reviewing this content, Chairman of the Economic and Financial Committee Phan Van Mai said that the draft law has made important progress in promoting the socialization of national reserve activities, contributing to diversifying resources, improving the flexibility of national reserves to reduce the burden on the state budget.

However, the provisions on the state policy on the socialization of national reserves in Article 4 of the new draft law are mainly "encouraging" and "creating conditions". There is still a lack of financial incentive mechanisms such as tax and credit policies or regulations on the socialization of national reserves related to state secrets.

It is recommended that the drafting agency study and supplement regulations on tax, financial, credit incentives, mechanisms for repurchasing and rotating reserve goods, ensuring risk sharing and harmonizing interests between the State and enterprises.

Complete regulations on inspection, examination, supervision, and mechanisms for mobilizing extra-budgetary resources to ensure transparency and sustainability of national reserves.

Regarding the state budget for national reserves, it is recommended that the drafting agency complete the regulations on spending authority; spending estimates; state budget spending for national reserve management activities; principles, management mechanisms, and accounting for revenue from the use of strategic reserves for business with the goal of regulating the market.
