The National Assembly Chairman emphasized that this content is very urgent, but there is not much time, so "temporarily accept to issue this weekend", and by 2026, a law on private economic development can be made.
According to Mr. Tran Thanh Man, the National Assembly will strive to pass this Resolution by 11am on Saturday (May 17).
The National Assembly Chairman also noted that relevant agencies should pay special attention to any content related to the private economy when amending and promulgating laws at this Session, especially laws on justice and tax.
Besides, it is necessary to change the mindset of the State to create instead of control, change the mindset of management and control to creating and serving, the State accompanies the private sector on the development journey.
Also at the request of the National Assembly Chairman, Government agencies and the National Assembly will complete the draft Resolution tonight (May 14), submit it to the National Assembly Standing Committee for conclusion, supplementation and posting for National Assembly deputies to comment.
Proposal not to apply retroactively to handle disadvantages for businesses
Presenting the Government's proposal, Deputy Minister of Finance Nguyen Duc Tam said that the goal of issuing the resolution is to promptly institutionalize a number of the Party's policies and guidelines stated in Resolution No. 68 to improve the investment and business environment, creating favorable conditions for the private economy to access resources.
At the same time, promote science, technology, innovation and digital transformation, green transformation, human resource training, expand the participation of private enterprises in important national projects, support pioneering enterprises, and reach international level to create "pushes, levers, and fulcrums" to create new momentum, liberate resources, and productivity of the private economy.
" The draft resolution stipulates a number of special mechanisms and policies for private economic development under the decision-making authority of the National Assembly that are different from the provisions of current law or have not been specifically stipulated, " said Mr. Nguyen Duc Tam.
According to the Deputy Minister of Finance, the draft Resolution stipulates special mechanisms and policies for private economic development to mobilize and diversify resources and free up social resources to focus on rapidly developing socio-economic infrastructure, meeting the requirements of double-digit economic growth in the next period.
The draft Resolution consists of 7 chapters and 17 articles, institutionalizing 5 major policy groups, including: improving the business environment; supporting access to land resources and production and business premises; supporting finance, credit and public procurement; supporting science, technology, innovation, digital transformation and human resource training; supporting the formation of medium and large enterprises and pioneering enterprises.
Notably, regarding the principles of handling violations in business activities, the draft resolution emphasizes a clear distinction between the responsibilities of legal entities and individuals; between criminal responsibilities and administrative responsibilities, civil responsibilities; and between administrative responsibilities and civil responsibilities.
In case of civil and economic violations and cases, priority shall be given to civil, economic and administrative measures; enterprises, business households and business individuals shall be allowed to proactively remedy violations and damages. In cases where the practical application of the law may lead to criminal prosecution or no criminal prosecution, criminal prosecution shall not be applied.
For violations that are subject to criminal prosecution, priority should be given to proactive, timely and comprehensive economic remedial measures first and this is an important basis for the prosecution agency to consider when deciding to initiate, investigate, prosecute, try and take further measures.
The draft resolution also clearly states that legal regulations cannot be applied retroactively to deal with disadvantages for businesses, business households, and business individuals.
The Government also proposed to ensure the principle of presumption of innocence in the process of investigation, prosecution and trial of cases; to reasonably use necessary measures to ensure the value of assets related to the case, and to minimize the impact of the investigation on production and business activities.
Examining this content, Chairman of the National Assembly's Economic and Financial Committee Phan Van Mai said that the Committee agreed with the necessity, political basis and practical basis of building and promulgating the Resolution according to the shortened procedures and order; agreed with the scope of regulation and scope of institutionalization of Resolution No. 68 in the draft Resolution.
Regarding the principles of inspection and examination activities, the examining agency proposed to study and supplement regulations on cases where the same content is not inspected or examined by a state management agency in the same year, except in cases where there is clear evidence of violations; inspection and examination plans and conclusions must be made public in accordance with the provisions of law.
Regarding support for access to land, production and business premises in industrial parks, industrial clusters, and technology incubators, Mr. Phan Van Mai proposed to study regulations in the direction of specifically determining the scale and area in each industrial park and industrial cluster for supported enterprises, avoiding the "ask - give" mechanism, taking advantage of policies, causing difficulties for business operations.
Regarding financial and credit support, the Government proposes that enterprises in the private economic sector, business households, and individual businesses receive State interest rate support of 2%/year when borrowing capital to implement green, circular projects and apply the environmental, social, and governance (ESG) standards framework.
To ensure that this policy is truly effective, the review agency noted that it is necessary to ensure clear regulations on criteria for determining loan subjects, strictly implement the principles of inspection and examination activities, and ensure that state agencies and commercial banks implement the principles of self-determination and self-responsibility when implementing the policy.
" At the same time, it is recommended to study and specify the form of refund to investors, ensuring the feasibility of the regulation, corresponding to the form of rental payment (one-time or annual) for land in industrial parks, industrial clusters, and technology incubators, whether it is a one-time payment or an annual payment ," said Mr. Phan Van Mai.
