Chemical Law 2025 – an opportunity for the chemical industry to make a breakthrough

Amending and supplementing laws and legal documents is always an objective need, in order to meet the requirements of socio-economic development and to be consistent with reality. Especially, in the context of the industry being strongly promoted, production and business activities using chemicals are increasingly expanding and diversifying, leading to many risks regarding safety and environment, the completion of the legal framework related to this activity is becoming increasingly urgent.

After 17 years of implementation, the 2007 Chemical Law has revealed shortcomings in chemical management, such as overlapping functions and tasks among state management agencies. This leads to a situation of dispersion of responsibilities and lack of coordination in monitoring and handling violations.

Therefore, as assigned by the Government, the Ministry of Industry and Trade has reviewed and assessed the implementation of the 2007 Chemical Law, as a basis for proposing the development of the amended Chemical Law to replace the current Chemical Law. On June 14, 2025, the National Assembly passed the Chemical Law No. 69/2025/QH15, which will take effect from January 1, 2026.

Overall, the Chemical Law 2025 is built in the direction of increasing decentralization and delegation of power; simplifying and cutting administrative procedures; and maximizing the application of information technology to improve the investment and business environment, creating favorable conditions for enterprises during the implementation process.

Along with that, the Law on Chemicals has added enforcement and appropriate transitional provisions to avoid creating gaps in management and minimize difficulties and obstacles for businesses.

The 2025 Chemical Law is considered an important and timely step to fully and comprehensively institutionalize the Party's guidelines and policies on sustainable development of the chemical industry, while contributing to ensuring national defense, security, social safety, and protecting people, facilities, assets, and the environment.

At the recent conference to disseminate the Chemical Law 2025 organized by the Hai Phong Department of Industry and Trade in coordination with the Department of Chemicals (Ministry of Industry and Trade), Mr. Pham Huy Nam Son, Deputy Director of the Department of Chemicals, commented: "The Chemical Law 2025 aims at comprehensive management of chemical activities, especially hazardous chemicals in products and goods. The law also stipulates more clearly the responsibility for safety in the supply chain, response to chemical incidents and enhances digital transformation through the application of the National Chemical Database System" .

Mr. Son also emphasized that, in addition to promoting the development of the chemical industry in a modern direction, the Law also focuses on protecting human health and the environment, in accordance with international commitments that Vietnam is participating in.

Therefore, the Chemical Law 2025 has paved the way for comprehensive institutional reform, promoting the chemical industry to develop sustainably and safely, meeting new requirements of the times.

Immediately after the Law on Chemicals 2025 was passed, Minister Nguyen Hong Dien issued Decision 2594/QD-BCT on the plan for implementing the law. The decision emphasized the need to organize intensive training, strengthen communication, build a series of events and columns to disseminate the law, and standardize documents and technical instructions to support businesses and local management agencies.

Immediately after that, the Department of Chemicals, together with localities such as Hung Yen, Hai Phong, Dong Nai, etc., quickly organized conferences to disseminate the Chemical Law 2025 to the business community. This is a key preparatory step, helping agencies and businesses quickly access the new regulations, creating a foundation for the implementation process to take place smoothly and minimizing problems and arising issues when the law is about to take effect.

As a locality in the early organizing group, on November 12, 2025, the Department of Industry and Trade of Thanh Hoa organized a conference to disseminate the Law on Chemicals 2025 with the participation of hundreds of enterprises, cooperatives and production facilities with chemical activities in the area.

Ms. Luu Thi Nga, Head of the Industrial Management Department (Thanh Hoa Department of Industry and Trade) said that organizing the conference is not only a professional task but also has urgent significance in this period.

“The law will take effect from the beginning of 2026, the remaining time is very short, while the new regulations are relatively numerous and directly impact business operations. If not disseminated early, businesses will be confused when implementing, especially regulations and requirements on chemical safety, declaration documents, operating conditions... Therefore, organizing conferences and training is necessary for units to grasp and fully prepare before the law takes effect" , Ms. Nga emphasized.

According to Ms. Nga, Thanh Hoa is a province with many production facilities using chemicals in industrial fields. Enterprises participating in the conference all appreciated the early and clear information provided, and especially the direct question and answer session from experts and reporters helped the business community grasp the new regulations, avoiding confusion and passivity when the law comes into practice.

On the business side, Mr. Le Huu Trung, an environmental officer at Miza Nghi Son Company Limited (a company specializing in paper production and recycling), commented that the authorities' proactive dissemination of the law in this context is a practical activity, helping businesses have enough time to move from "knowing" to "understanding and doing", "proactive" instead of "passive".

“Getting information early not only helps us know that the law will change, but also gives us time to research deeply and understand the nature of each new regulation. From there, we can build a detailed action plan, allocate resources appropriately to upgrade warehouses, update chemical safety data sheets (SDS), retrain the operating team and respond to incidents,” said Mr. Le Huu Trung.

Mr. Trung added that instead of waiting until January 1, 2026 to frantically research, businesses can start reviewing right now. What is not suitable will be planned for improvement, what is missing will be supplemented. This initiative helps businesses avoid legal risks, not interrupt production and, more importantly, ensure absolute safety in operations.

Up to now, less than two months is not much time for management agencies, businesses and related organizations to research, update and prepare conditions for implementing the Chemical Law 2025. Therefore, the current requirement is not only to complete the system of related documents but also to urgently disseminate and train the business community to grasp the new regulations, ensuring that when the law comes into effect, it will be applied smoothly. On their part, businesses need to proactively learn and update to equip themselves with the necessary legal provisions, minimizing violations due to not understanding the new regulations.
