Delegate Tran Quoc Tuan (Tra Vinh Delegation) expressed his concern and agreed with the limitations pointed out in the Government 's report on "a number of cadres and civil servants who are not yet resolute, have a mentality of avoidance, fear of responsibility, shirking responsibility, fear of making mistakes, causing congestion, hindering the country's development". The delegate raised the question, why did cadres who were afraid of responsibility not appear before but only appear now; not only that, but it has spread from the central to local levels, continuing to spread from the public sector to the private sector?

"It is necessary to determine the cause of this disease in order to treat it effectively," said the delegate.

The delegate said that it is necessary to differentiate and identify who are the cadres who are afraid of responsibility, what causes the existence of these cadres, and from there find timely and effective solutions. According to delegate Tran Quoc Tuan, among the cadres who are afraid of responsibility, there are two groups: those who have degraded in political ideology and do not want to do things because they do not have personal benefits; those who are afraid of violating the law and do not dare to do things.

Regarding the group of cadres who have degraded in political ideology and do not want to work because they do not have personal interests, the delegate of Tra Vinh Delegation believes that this can be overcome immediately, with priority given to replacing them with good cadres who have enough enthusiasm and responsibility.

"We do not lack good staff," the delegate affirmed, saying that like in football, the head coach will replace a player for the sake of the flag and the team if the player on the field performs poorly.

Regarding the group of officials who are afraid of violating the law and therefore do not dare to do anything, delegate Tran Quoc Tuan said that this group is the majority; it is the biggest obstacle causing work congestion in the entire system. According to the delegate, this group of officials is afraid of violating the law for two reasons: Some current legal documents, especially sub-law documents, still lack uniformity.

"I witnessed on the sidelines of this session, two National Assembly deputies debated the content of a provision of a law that is still in effect. The debate made me very concerned and worried because it was happening in the legislative body itself, so it cannot be ruled out that it will happen in executive agencies, leading to many different consequences for civil servants," the deputy said.

In addition, the work of inspection, examination, prevention and fight against negative corruption is increasingly becoming more substantial, being implemented drastically and effectively, causing many officials to be afraid because they have committed similar violations in the past. This has created a spreading effect to other officials, forming a mentality of fear and fear of being disciplined, especially being criminally prosecuted. Among them, there are some dedicated and responsible officials who cannot carry out their work due to the inadequacy and lack of consistency in legal documents.

In the long term, delegates proposed that the National Assembly and the Government review and perfect the legal system related to civil servants and public employees to ensure consistency, no overlap or contradiction; on that basis, protect and encourage dynamic, creative cadres and civil servants who dare to think and dare to act for the common good.

The delegate also said that it is necessary to further promote decentralization and delegation of power to reduce pressure and burden on higher-level agencies, while increasing responsibility for localities and lower-level agencies. To do so, it is necessary to determine which tasks are the responsibility of the locality, boldly delegate power to the locality, and the locality will be responsible before the law. At the same time, continue to strengthen inspection and supervision to guide, remind, and urge effective implementation of public duties.
