Regarding the draft Law on E-commerce, delegate Nguyen Phuong Tuan, Vice Chairman of the National Assembly's Committee on Science , Technology and Environment, and the National Assembly Delegation of An Giang province, requested the drafting agency to review and compare the provisions of the draft law with the Law on Electronic Transactions, Law on Credit Institutions, Law on the State Bank of Vietnam, Law on Consumer Rights Protection, Law on Data, etc. and the draft laws being submitted to the National Assembly for consideration and approval (Law on Cyber Security, Law on Digital Transformation).

Regarding Article 3 (Interpretation of terms) of the draft Law on E-commerce, delegate Nguyen Phuong Tuan proposed adding the concept of "e-commerce platform owner" to distinguish it from "e-commerce platform manager", avoiding confusion in understanding and implementing the law later, ensuring continuity with relevant decrees issued by the Government .
It is recommended to consider the concept of “foreign seller” (Article 17) because it is almost similar to Article 18 (Foreign organizations and individuals are organizations and individuals established and registered for business under the provisions of foreign law or recognized by foreign law). At the same time, the term “foreign buyer” is not explained, it is recommended to consider adding it.
Article 6 stipulates prohibited acts, including Clause 3: "Forcing or preventing users of e-commerce platforms owned by oneself to register to use other digital platforms as a mandatory condition for using the service".
Therefore, the delegate proposed to study and clarify whether this provision applies to “e-commerce platform owners” or “e-commerce platform owners”. In case this provision remains unchanged, it is recommended to supplement the concept and regulations related to “e-commerce platform owners”.
