Ensuring fairness and stability in notary activities

Performing the state management function in the field of notarization, every year the Department of Justice actively advises the Provincial People's Committee to organize propaganda, dissemination and enforcement of legal regulations and policies on notarization. In particular, after the Notarization Law No. 46/2024/QH15 was passed by the 15th National Assembly and took effect from July 1, 2025, the Department of Justice promptly issued a plan to implement the law; coordinated with the Provincial Notary Association to organize professional training for more than 200 notaries and professional staff, focusing on new points of the law and documents guiding its implementation.

Notary Public of Notary Office No. 1 handles administrative procedures for citizens.

In June 2025, the Department of Justice advised the Provincial People's Committee to allow the establishment of a Notary Office in Ba Che district to meet the needs of people in remote areas, contributing to promoting the socio -economic development of the locality. From July 1, 2025, the authority to appoint notaries was delegated to the Chairman of the Provincial People's Committee. The Department of Justice advised on the appointment of 7 notaries, supplementing human resources for notary organizations.

Currently, the province has 30 notary organizations (2 notary offices and 28 notary offices) with 73 notaries in operation. These organizations are constantly improving their professional capacity, innovating their service style towards professionalism and modernity, creating a healthy competitive environment, reducing the burden on the public sector, and at the same time bringing convenience and trust to people when carrying out notary procedures.

In line with the province's policy on building digital government, in 2024, the Department of Justice completed the construction of the Quang Ninh Provincial Notary Database, an important step in digitizing notary activities. On that basis, the Provincial People's Committee issued decisions on the Regulations on management, exploitation and use of the notary database and approved the security level of the information system. The notary database officially went into operation on June 11, 2024, creating a foundation for connecting and sharing data between notary organizations and functional agencies. As of October 30, 2025, the system had updated more than 157,000 notary data, 284 prevention and reference information, contributing to limiting risks, preventing illegal transactions, and ensuring legal safety for contracts and civil transactions.

In order to strengthen management effectiveness, from 2024 to now, the Department of Justice has conducted 20 inspections and examinations of notary organizations. Thereby, promptly correcting existing problems, sanctioning administrative violations against violating organizations and individuals; at the same time, guiding and supporting to overcome and ensure notary activities comply with legal regulations.

The Department of Justice coordinated with the Provincial Notary Association to organize notary training in 2025.

In 2024 and the first 6 months of 2025, notary organizations in the province performed 171,866 notarizations (including nearly 154,000 contracts and transactions); certified 666,831 copies, 1.37 million other certifications, total notarization fee revenue of nearly 113 billion VND and paid to the budget and taxes of more than 10 billion VND.

Implementing the policy of arranging the administrative apparatus according to the 2-level local government model, the Department of Justice has issued guiding documents to resolve difficulties in notarization activities; at the same time, advised the Provincial People's Committee to draft a resolution stipulating the tasks and powers of the Chairman of the Commune People's Committee authorized to civil servants to perform in the field of certification, ensuring compliance with the conditions of organizing the new apparatus (Resolution No. 78/2025/NQ-HDND approved by the Provincial People's Council on October 17, 2025).

In addition, implementing the policy of socializing notary activities, the Department of Justice has established a project development team to convert Notary Office No. 3 of Quang Ninh province into a Notary Office, and submit to the Provincial People's Committee to issue a plan on converting and dissolving Notary Offices under the Department of Justice. Currently, the project development team has completed the draft to collect comments from relevant departments and branches, and is expected to submit to the Provincial People's Committee in November 2025.

In addition to the achieved results, the state management of notarization still faces difficulties, especially in the transitional period when the Notarization Law 2024 takes effect in parallel with the reorganization of the apparatus according to the 2-level local government model. However, with the initiative of the Judicial sector, the coordination of the Notary Association and relevant agencies, Quang Ninh is gradually perfecting the management model, aiming to build a modern and transparent notarization organization system, meeting the requirements of the digital economy and increasingly better serving the legitimate rights and interests of people and businesses.
