(Chinhphu.vn) - The Ministry of Public Security has proposed removing the requirement to submit a certificate of marital status when buying and selling land and vehicles for people whose data is digitized and authenticated on the national system.

The Ministry of Public Security is seeking opinions from ministries and branches to complete the draft Resolution on eliminating notarization procedures and confirmation of marital status in land and vehicle transactions for cases where data has been digitized and cleaned.

No need to notarize the contract, no need to confirm marital status

The draft was developed according to the tasks assigned by the Government in Resolution 205/NQ-CP, aiming to simplify administrative procedures, increase the use of digital data, and reduce the number of documents citizens must present.

Transactions regulated by this Resolution include: Transactions of purchase, sale, transfer, donation, mortgage, inheritance of land use rights and assets attached to land; transactions of purchase, sale, transfer, donation, registration of ownership of means of transport.

This means that when people carry out the above transactions, they will not need to notarize the contract, confirm their marital status or present copies of personal documents.

Instead, electronic data is collected and authenticated from national databases that have legal value in place of paper documents. People do not have to re-submit documents already in the digital data system.

The officer handling the procedure is responsible for looking it up on the system. Electronic transaction contracts are signed with digital signatures or level 2 identification accounts, which have the same legal value as notarized contracts. However, people still have the right to voluntarily request notarization and certification if they want.

Level 2 electronic identification account has the same legal value as a notarized contract.

Also according to the draft, in case the data system has not updated the marital status or property ownership, the receiving agency may request people to supplement relevant documents. Instruct people to update civil status data, identification or level 2 VNeID authentication according to regulations to use the shortened process in the next transactions.

Regarding the responsibility for storage and legal assurance, the draft stipulates that contracts and transaction records are stored electronically in the transaction management information system of competent State agencies.

Transaction contracts electronically signed and authenticated by Level 2 Electronic Identification Accounts have the same legal value as notarized and certified contracts.

The receiving agency is responsible for fully storing the processing log, lookup information, and exploitation to serve the work of inspection, examination, dispute resolution, or violation handling (if any).
