Strengthening Vietnam-Russian Federation cooperation in the field of notarization

(Chinhphu.vn) - On November 16, in Nha Trang, the Vietnam Association of Notaries (VNA) and the Russian Federation Notary Association (FCR) jointly organized the international conference "Sharing international experience in notarization".

The workshop was attended by representatives of central ministries and branches, the Consulate General of the Russian Federation in Ho Chi Minh City, along with legal experts and notaries from the two countries.

The workshop was organized to enhance professional exchange, promote bilateral cooperation in the field of notarization and support the completion of the legal framework serving state management activities.

Speaking at the workshop, the representative of the Vietnam Notary Association emphasized the importance of referring to international experience, especially in the context of Vietnam implementing the Notary Law 2024 and tasks related to digital transformation in the judicial sector.

The representative of the Russian Federation Notary Association affirmed that Vietnam is an important partner of the Russian Federation in the field of notarization, and emphasized the need to maintain regular cooperation to share information, management experience and good practices in organizing notarization activities.

In the workshop program, the representative of the Russian Federation presented an overview of the professional liability insurance system and the compensation mechanism for notaries. Accordingly, Russia is one of the countries that early applied the compulsory civil liability insurance mechanism for notaries right from the transition period to the private notary model.

After many legislative improvements, Russia has built a four-tier insurance system including: Personal liability insurance, collective insurance by regional notary associations, personal property liability of notaries and the centrally managed Federal Compensation Fund. This fund currently has a size of over 1.3 billion rubles and is used to pay in cases of damage exceeding the capacity of the remaining three insurance tiers.

According to the Russian Federation Notary Association, the multi-tiered insurance mechanism helps ensure full compensation for victims and increases the responsibility of notaries in their practice. This is one of the important factors contributing to ensuring the legal safety of the civil transaction system.

The Vietnamese representative presented the experience in implementing the financial guarantee system in notary activities according to the Notary Law 2024 and Decree 104/2025/ND-CP. Accordingly, Vietnam currently applies a two-tier mechanism including compulsory professional liability insurance and a Compensation Fund managed by the Vietnam Association of Notaries. This mechanism is assessed to be suitable for practical conditions and ensures harmony between state management requirements and the financial capacity of the notary team.

In addition to the insurance content, the Workshop devoted a considerable amount of time to exchanging experiences on digital transformation in notary activities. The representative of the Russian Federation introduced in detail the Unified Information System (EIS) - a national digital platform for unified management of notary activities. The system includes electronic registers, notary transaction data, inheritance information, real estate mortgage information, power of attorney information and other legal data. EIS allows real-time data connection, serving the purpose of searching, verifying and preventing fraud, and supporting the implementation of remote notarization in accordance with Russian law.

According to the delegates, the Russian Federation’s experience in implementing EIS is an important reference source for Vietnam in the context of researching the construction of a unified database on notarization and promoting comprehensive digital transformation in this field. The application of information technology is considered a necessary condition to ensure transparency, improve efficiency in serving people and businesses, and support state management agencies in monitoring and organizing law enforcement.

Speaking at the end of the workshop, Executive Vice President of the Vietnam Notary Association Nguyen Thi Tho acknowledged the practical sharing from the Russian Federation and affirmed that the workshop contributed to enhancing mutual understanding between the two associations.

Ms. Nguyen Thi Tho said that the Cooperation Agreement signed on this occasion will be an important basis for implementing many practical cooperation programs in the coming time, especially in the fields of human resource training, insurance model research, building a damage compensation mechanism and applying technology in notary management.

Representatives of the Russian Federation Notary Association also expressed their desire to continue accompanying the Vietnam Notary Association in implementing professional cooperation programs, expanding experience exchange at regional and association levels, and promoting cooperation in the field of digital transformation.

* Within the framework of the Workshop, the Signing Ceremony of the Cooperation Agreement between the Vietnam Notary Association and the Russian Federation Notary Association took place. This document establishes an official cooperation framework between the two associations, creating a basis for the implementation of coordinated activities on professional training, data exchange, research on organizational models and technical support in the process of applying information technology to notary activities.

The signing took place under the witness of representatives of state management agencies, demonstrating the Vietnamese State's interest in improving quality and enhancing legal safety in civil transactions.
