Residents "stuck" in a snail-paced project.

Life is tough on the project.

The Northwest Main Road Project (sections from the Hue intersection to the Da Nang Oncology Hospital, from Ho Tung Mau to National Highway 1A, and connecting Nguyen An Ninh from the National Highway 1A intersection to the railway) had an initial total investment of over 692 billion VND. However, due to land acquisition issues, prolonged implementation, and resulting inflation in compensation costs, the total investment had to be increased to 966 billion VND.

In late March 2022, the Chairman of the People's Committee of Da Nang City issued Decision No. 776 setting the completion deadline for the Northwest Main Road I project at the end of June 2023. However, to date, the project has still not been put into use.

Having lived and built a house on land given to them by their parents for over 20 years, Mr. Tran Van Thanh's family (in Group 24, Hoa Khanh Bac Ward, Lien Chieu District) has been unable to obtain a land ownership certificate because the land is located within a planned project area.

Mr. Thanh said that this project was planned a long time ago, so his family couldn't get a land title. Furthermore, the compensation plan for households like his is still unclear. For years, residents have had to live with pollution in dilapidated, run-down houses. When it rains heavily, the area is flooded, forcing many households to flee the rising water.

"The people are willing to hand over the land for the project's construction. However, the government must have the most reasonable compensation plan so that people can stabilize their lives as soon as possible," Mr. Thanh said.

In this project, there are still 19 households that have not received compensation and have not accepted the compensation policy because they built houses on agricultural land within the area designated for clearance in the Northwest Resettlement Area No. 1 project, managed by the Management Board of Investment and Construction Projects for Civil and Industrial Works.

Mr. Vo Thanh Luong (head of group 24, Hoa Khanh Bac ward) said that most residents here are eager for the project to be completed soon to promote economic development and improve transportation. However, Mr. Luong also shared that many households along the Northwest arterial road are still facing difficulties in land clearance and compensation, mainly because they built their houses on land that is not designated as residential land.

Efforts to find common ground

According to the People's Committee of Lien Chieu District, Da Nang City, as of now, 59 out of 164 land handover dossiers for the Northwest Axis I road project have been completed. The land handover rate is 35.8%, with 105 dossiers remaining to be handed over.

Mr. Nguyen Dang Huy, Chairman of the Lien Chieu District People's Committee, said that land clearance in the area is currently facing many difficulties. Most of the projects are old, having been implemented many years ago, resulting in low compensation values. The majority of households have received 80% of the compensation, with 20% remaining unpaid and land yet to be handed over. The prolonged projects have made persuading residents to cooperate more difficult.

In addition, many households built houses on land that is not designated as residential land, and have not received compensation for the land or been allocated resettlement, leading to prolonged petitions and a failure to comply with the land handover requirements.

Another reason for the prolonged land clearance process is that the majority of households allocated resettlement land receive compensation for the land itself that is lower than the amount they are required to pay for the land use rights of the allocated plot. Therefore, these households are unable to pay the land use fees necessary for building their houses and have not yet complied with the land handover requirements.

Regarding future solutions, the Lien Chieu District People's Committee is submitting a proposal to the City People's Committee for consideration of a special mechanism for the project to accelerate the land clearance process.

Accordingly, for the 19 cases of agricultural land, the Council is currently... Organize public consultations, gather feedback from households affected by land clearance, and provide support of up to 20 million VND to these households, while also encouraging them to hand over the land.

With 40 cases already resettled, a 10% inflation adjustment for houses and structures has been implemented, along with a minimum resettlement allowance.

Furthermore, for households building houses on non-residential land in Hoa Khanh Bac ward, efforts will continue to be made to complete the necessary legal documents and finalize the approval of compensation, support, and resettlement results for affected households in accordance with regulations.

In cases where houses were built on agricultural land and compensation was paid in full according to regulations, and despite being persuaded and explained to by relevant agencies and levels, the owners still refused to hand over the land, the process of preparing dossiers for forced land reclamation was carried out in 2023.

For cases where resettlement land is allocated, the Council has met with the residents, and after the support is approved, they will send a notification and request the final payment and handover of the land.

The Northwest Axis I road project is managed by the Investment and Construction Project Management Board for Transportation Works. The project was approved by the Chairman of the People's Committee of the city in September 2019.
