Continuing the session's agenda, on the morning of October 31, the National Assembly listened to the Presentation and Verification Report on the following projects: Law amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization; Law on Cyber ​​Security; Law on Protection of State Secrets (amended); Law amending and supplementing a number of articles of 10 laws related to security and order; Law amending and supplementing a number of articles of the Law on International Treaties; Law on Digital Transformation; Law on High Technology (amended); Law amending and supplementing a number of articles of the Law on Technology Transfer.

Ensuring data security

Presenting the Report on the above 4 projects, Minister of Public Security Luong Tam Quang said that the development and promulgation of 4 draft laws aims to ensure that the provisions of these laws are consistent with the results of the reorganization of the state apparatus and 2-level local government; meet urgent practical requirements, and are consistent with the policy of breakthrough in science and technology development, innovation, and national digital transformation.

The draft Law amending and supplementing a number of articles of the Law on National Defense and Security Industry and Industrial Mobilization consists of 2 articles, with basic contents, including: Separating the National Defense and Security Industry Fund into 2 independent funds (including the Security Industry Development Investment Fund and the National Defense Industry Fund); adding 1 section on the National Security Industry Complex to Chapter II; adding regulations on the "Security Industry Development Management Council" established by decision of the Minister of Public Security and being the Chairman of the Council...

The draft Law on Cyber ​​Security consists of 9 chapters and 58 articles, including 30 provisions inherited from the 2018 Law on Cyber ​​Security, 16 provisions inherited from the 2015 Law on Network Information Security; 9 provisions merged and 3 new provisions added. The amended and supplemented provisions focus on the following issues: Supplementing provisions on ensuring data security; supplementing provisions on responsibility for identifying IP addresses and providing them to specialized forces for protecting cyber security; supplementing provisions on funding for protecting cyber security of agencies, organizations, state-owned enterprises, and political organizations; supplementing provisions on encouraging the use of Vietnamese security industry products and services; supplementing provisions on granting cyber security certificates.

The draft Law on Protection of State Secrets (amended) focuses on a number of new points, including: Expanding the permission to copy, extract, and store state secrets in the electronic environment; adding regulations prohibiting the use of artificial intelligence systems to violate state secrets; adding authority and responsibility in state secret protection activities for commune-level authorities and a number of central agencies organized according to the regional model; adding and perfecting regulations on handling documents containing state secret content in the electronic environment; and at the same time abolishing a number of administrative procedure regulations within agencies, organizations, units, and localities related to state secret protection activities.

The Draft Law amending and supplementing a number of articles of 10 laws related to security and order consists of 12 articles, of which 136/570 articles are amended and supplemented and 2 new articles are added to 10 laws related to security and order.

In particular, for the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam: Amending and supplementing regulations on visa incentives and temporary residence cards for foreigners; temporary residence period of foreigners; authority to issue permanent residence cards; Vietnamese citizens permanently residing in the country are allowed to invite and sponsor foreigners who are grandchildren to enter Vietnam; authority to regulate the issuance and use of electronic identification for foreigners.

Regarding the Law on Exit and Entry of Vietnamese Citizens: Amending and supplementing regulations on the validity of ordinary passports; cases where exit and entry documents have not been issued; cases where passports are revoked or invalidated; responsibilities for regulating the issuance of diplomatic notes to support visa applications.

Regarding the Law on Residence: Amending and supplementing regulations on permanent and temporary residence registration for children under 6 years old; permanent residence registration for minors; deletion of permanent and temporary residence registration when the decision to restore Vietnamese nationality is revoked; the vehicle owner or the person assigned to manage the vehicle is responsible for notifying the residence.

Regarding the Law on Identification: Amending and supplementing regulations on: identification management agencies; revocation of identification cards; validity of electronic identification.

Regarding the Law on Road Traffic Order and Safety: Amending and supplementing regulations on priority light signal colors for military vehicles; smart vehicles; vehicles that must be equipped with journey monitoring devices, driver image recording devices, passenger compartment image recording devices; responsibility of vehicle inspection facilities to refuse vehicle inspection; upgrading driving licenses; authority to regulate training, testing, granting, exchanging, re-granting, and revoking driving licenses for defense and security purposes...

For the Road Law: Amending and supplementing regulations on road traffic safety inspection and assessment.

Regarding the Law on Management and Use of Weapons, Explosives and Supporting Tools: Amend and supplement regulations on 11 administrative procedures to create more favorable conditions for agencies, organizations and individuals.

Presenting the Report on the draft Law on amending and supplementing a number of articles of the Law on International Treaties, Minister of Foreign Affairs Le Hoai Trung stated that the main contents focus on three issues: overcoming a number of current difficulties and obstacles related to the order and procedures for negotiating, signing, approving, ratifying, amending, supplementing, extending and implementing international treaties on ODA and preferential loans in accordance with the provisions of the law on public debt management...; reducing and simplifying processes and procedures; implementing decentralization and delegation of authority in the work of signing international treaties.

Clarifying the functions and tasks of the Security Industry Development Management Council

Examining the draft Law amending and supplementing a number of articles of the Law on Defense Industry, Security and Industrial Mobilization, the National Assembly's Committee on Defense, Security and Foreign Affairs proposed to study the concept of the Security Industry Development Investment Fund to make it clearer, covering practical needs; clarify the position, functions and tasks of the Security Industry Development Management Council; and clearly define the responsibilities of this organization with the "Security Industry Specialized Agency".

Regarding the draft Law on Cyber ​​Security, the examining agency proposed to review and supplement all prohibited acts, especially acts of using artificial intelligence to create, edit, and spread false information, impersonate identities to slander, defraud, and harm national security and social order; proposed not to re-regulate acts already in the Penal Code. In addition to protecting children, it is necessary to add subjects of protection to vulnerable people such as the elderly, people who have lost or have limited civil capacity; supplement regulations to prevent, stop, and promptly handle acts of using artificial intelligence to simulate faces to defraud, defame, and impersonate famous people or their relatives.

Regarding the draft Law on Protection of State Secrets (amended), the examining agency proposed to supplement regulations on the responsibility of the entity receiving documents and containers of state secrets; criteria for deciding to extend the period of protection of state secrets and the maximum extension period; the process of determining and stamping the confidentiality level of electronic documents of state secrets.

Regarding the draft Law amending and supplementing a number of articles of 10 laws related to security and order, the Committee for National Defense, Security and Foreign Affairs basically agrees with the contents adjusted in the draft Law, which focuses on issues related to the arrangement of organizational apparatus, decentralization, delegation of power and removing difficulties, obstacles and "bottlenecks" due to legal regulations and law implementation.

Regarding the draft Law amending and supplementing a number of articles of the Law on International Treaties, there are opinions in the appraisal agency suggesting amending the regulations on examination and appraisal of international treaties, in the direction of combining the process of examination and appraisal of international treaties to reduce the process and procedures.

Encourage and promote high-tech activities

In this morning's session, the National Assembly also heard the Presentation and Verification Report on three projects: the Law on Digital Transformation, the Law on High Technology (amended), and the Law on amending and supplementing a number of articles of the Law on Technology Transfer.

Presenting the Report, Minister of Science and Technology Nguyen Manh Hung said that the development of the Law on Digital Transformation is necessary to perfect the legal system on national digital transformation, create an inter-sectoral legal system on digital transformation in industries and fields; regulate the relationship between entities participating in activities in the digital environment; promote the comprehensive digital transformation process; strengthen international cooperation and integration. This Law regulates digital transformation, including: infrastructure for digital transformation; digital government and digital transformation of activities of agencies in the political system; digital economy; digital society and measures to ensure digital transformation.

The amended and supplemented contents in the Law on Technology Transfer focus on 6 policy groups. In particular, determining the scope of technology regulated in the Law to cover new technology according to world trends and practical requirements; supporting and promoting endogenous technology transfer, including technology transfer between domestic enterprises/organizations and individuals, commercializing results and developing...

The structure of the Draft Law on High Technology (amended) includes 6 chapters and 27 articles; regulations on high-tech activities, policies, measures to encourage and promote high-tech activities. The Draft Law includes 6 policy groups. Policy 1: Perfecting the concept and criteria of high technology; Policy 2: Redesigning the system of policies and beneficiaries of priority, incentive and investment support policies; Policy 3: Encouraging the development of the high-tech ecosystem; Policy 4: Supplementing regulations on models of high-tech parks and high-tech cities; Policy 5: Supplementing and perfecting regulations on state management of high technology, management, inspection, supervision and efficiency assessment mechanisms; Policy 6: Supplementing regulations on requirements for comprehensive digital transformation of high-tech activities.

Agreeing with the need to promulgate the projects: Law on Digital Transformation, Law on High Technology (amended), Law on amending and supplementing a number of articles of the Law on Technology Transfer according to shortened procedures, the National Assembly's Committee on Science, Technology and Environment requested the drafting agency to continue reviewing and comparing the provisions in the draft Law with other relevant laws to ensure consistency and uniformity in the legal system.

Regarding the draft Law on Digital Transformation, the reviewing agency believes that for digital transformation projects and tasks using the state budget, it is necessary to consider adding a group of preferential policies and special support on investment, procurement and financial management to ensure flexibility and efficiency.

Regarding the draft Law on High Technology (amended), the draft Law has stipulated many preferential, supportive, attractive and encouraging policies for investment, production and business activities in the high-tech sector. The reviewing agency proposed to clarify more about the guaranteed resources as well as the coordination mechanism between agencies in implementation; it is necessary to stipulate that incentives only apply to high-tech production activities during the time when enterprises meet the prescribed criteria. For high-tech projects in ethnic minority, border and island areas, it is necessary to study and supplement policies on corporate income tax exemption and reduction, support for 0% interest rate loans for investment in digital infrastructure development, and prioritize land allocation for high-tech zones.

Regarding the draft Law amending and supplementing a number of articles of the Law on Technology Transfer, the Committee on Science, Technology and Environment requested the drafting agency to conduct research, closely follow the orientation and requirements of Resolution No. 57-NQ/TW dated December 22, 2024 of the Politburo, and add to the draft Law preferential and support policies for small and medium-sized enterprises in research, reception, innovation, mastery and application of technology. In addition, it is recommended to review and research additional incentive mechanisms to effectively implement the policy of "diffusion of technology... from foreign-invested enterprises (FDI) to domestic enterprises".
