Proposing new regulations on health insurance for police officers, employees and relatives of police officers

The Ministry of Public Security has drafted a Circular stipulating measures to implement health insurance for police officers, employees, students and relatives of police officers, soldiers and workers working and studying in the People's Public Security Forces to solicit public opinions.

Regarding the subjects participating in health insurance, Clause 1, Article 2 of the draft Circular stipulates:

a) Police workers.

b) Employees working under indefinite-term labor contracts; labor contracts with a term of 1 month or more; citizens who are in the temporary recruitment period before being officially recruited into the People's Public Security (hereinafter referred to as employees).

c) Relatives of professional officers, non-commissioned officers and technical officers and non-commissioned officers currently working in the People's Public Security Force; relatives of non-commissioned officers and soldiers currently serving for a limited term in the People's Public Security Force; relatives of Vietnamese police students receiving living allowances studying at schools inside and outside the People's Public Security Force (hereinafter referred to as relatives of officers and soldiers) and relatives of police workers specified in Point a of this Clause who are not eligible for health insurance specified in Points a, b, c, d, dd, e, g and h, Clause 1, Clause 2 and Clause 3, Article 12 of the Law on Health Insurance as amended and supplemented, including: Biological father, biological mother; biological father, biological mother of the wife or husband; legal guardian of the self, of the wife or husband; wife or husband; biological children, legally adopted children from over 6 years old to under 18 years old; Biological and legally adopted children aged 18 years or older if still attending secondary school; biological and legally adopted children of the wife or husband (living with the officer or soldier) aged 6 to under 18 years old or over 18 years old if still attending school.

d) Students studying at the People's Public Security Cultural School including foreign students.

d) Civil students studying at People's Public Security schools.

Students studying at the People's Public Security Cultural School, including foreign students, are proposed to pay a monthly health insurance premium equal to 4.5% of the reference level.

Also according to the draft Circular, the monthly health insurance contribution rate is determined according to the percentage of salary used as the basis for compulsory social insurance contribution according to the provisions of the Law on Social Insurance (hereinafter referred to as monthly salary) or the reference level applied according to the provisions at Point b, Clause 5, Article 3 of the Law amending and supplementing a number of articles of the Law on Health Insurance. Specifically as follows:

1. For the subjects specified in Point a, Point b, Clause 1, Article 2 of this Circular, the following shall be implemented:

a) Equal to 4.5% of monthly salary, of which the unit and local police pay 3% and the employee pays 1.5%.

For employees receiving salaries from the state budget, the amount of health insurance premiums is the responsibility of the local police (employer) and is guaranteed by the state budget.

For employees who do not receive salaries from the state budget, the amount of health insurance premiums that is the responsibility of the local police is included in production and business expenses according to the provisions of law.

b) In case an employee has one or more indefinite-term labor contracts or labor contracts with a term of 1 month or more, the monthly salary for health insurance payment shall be implemented according to the labor contract as the basis for participation in compulsory social insurance.

c) During the time the subjects specified in Point a, Point b, Clause 1, Article 2 of this Circular take leave to receive sick leave benefits due to illness on the list of illnesses requiring long-term treatment or take leave to receive sick leave benefits for 14 working days or more in a month or take leave to receive maternity leave benefits for 14 working days or more in a month according to the provisions of the law on social insurance, the monthly health insurance contribution rate is equal to 4.5% of the reference level. The unit and local police are responsible for making a list of health insurance participants and sending it to the social insurance agency that issued the health insurance card to record the collection and settle the payment with Vietnam Social Insurance.

d) During the period of detention, temporary detention or temporary suspension from work for investigation and consideration of whether or not there is a violation of the law, health insurance contributions must be paid according to the provisions of Point a, Clause 1, Article 7 of Decree No. 146/2018/ND-CP.

2. The monthly health insurance contribution level of the subjects specified in Point c, Clause 1, Article 2 of this Circular is equal to 4.5% of the reference level. The state budget ensures health insurance contributions for relatives of officers, soldiers and relatives of police workers receiving state budget salaries; the health insurance contribution cost for relatives of police workers not receiving state budget salaries is paid by the police of the unit or locality and is accounted for in production and business expenses according to the provisions of law.

3. The monthly health insurance contribution level of the subjects specified in Point d, Clause 1, Article 2 of this Circular is equal to 4.5% of the reference level and the unit and local police pay from the following sources:

a) For students with Lao and Cambodian nationality, use training funding sources according to regulations in Article 4 of Circular No. 75/2023/TT-BTC dated December 28, 2023 of the Minister of Finance guiding the management of training funding for Lao and Cambodian students (under the Agreement) studying in Vietnam using aid funds from the Government of Vietnam;

b) For Vietnamese students, the budget guarantees.

4. The monthly health insurance contribution level of the subjects specified in Point d, Clause 1, Article 2 of this Circular is equal to 4.5% of the reference level, in which the state budget supports at least 30% of the health insurance contribution level, the remaining part is paid by the individual. When the state adjusts the health insurance contribution level, adjusts the reference level, the health insurance participant and the state budget do not have to pay additional or are not refunded the difference due to the adjustment of the health insurance contribution level, the reference level for the remaining period that the participant has paid health insurance.

The Draft Circular is posted on the Ministry of Public Security's Electronic Information Portal for comments within 60 days from March 27, 2025.
