Proposing regulations on job placement, job change, and civil servant ranking according to job position

(Chinhphu.vn) - The Ministry of Home Affairs is drafting a Decree regulating the recruitment, use and management of civil servants. Accordingly, the Ministry proposes regulations on the arrangement, change of job positions, and ranking of civil servants according to job positions.

The Ministry of Home Affairs proposes regulations on job placement, job change, and civil servant ranking according to job position.

The Ministry of Home Affairs said that the Law on Cadres and Civil Servants 2025 has amended and supplemented basic contents related to the recruitment, use and management of civil servants, such as:

(1) Transform the method of managing cadres and civil servants according to job positions. Accordingly, clearly stipulate that the evaluation, arrangement and use of cadres and civil servants must be based on the requirements of the job position and the capacity, results and effectiveness of performing the tasks of cadres and civil servants; abolish the regulation on rank promotion exams, instead, the mechanism of arranging each job position to the corresponding civil servant rank, linked to the capacity and results of performing the tasks, thereby minimizing administrative procedures, creating real motivation for cadres and civil servants.

(2) Innovate the recruitment of civil servants in the direction that the selected person must immediately meet the requirements of the job position, after being selected, he/she will be appointed, and his/her salary will be arranged in the civil service grade corresponding to the selected job position and he/she will not have to undergo an internship. Regulate flexible recruitment methods, in addition to traditional examinations and selection, and supplement the reception method for talented and experienced people from the non-public sector, public service units, state-owned enterprises, etc. Eliminate the regulation on unified quality assessment of civil servant input at the national level to implement the policy of promoting decentralization and delegation of power in civil servant management, while strengthening the mechanism of post-inspection, inspection, and examination, ensuring decentralization goes hand in hand with effective control of power.

In the draft, the Ministry of Home Affairs proposed to add a Section regulating the arrangement, change of job positions, and ranking of civil servants according to job positions (Section 1, Chapter III, consisting of 04 articles, from Article 19 to Article 22) stipulating: (1) Arrangement of job positions and ranking of civil servants for those who pass the civil service recruitment exam; (2) Cases of changing job positions; (3) Changing job positions with civil servant ranks ranked according to professional and technical levels higher than the current rank; (4) Changing job positions with civil servant ranks ranked according to professional and technical levels lower than the current rank.

Job placement and civil servant rank for successful civil servant candidates

According to the draft, the arrangement of job positions for those who pass the entrance exam or selection at the agency employing civil servants must be consistent with the job positions identified in the recruitment plan, ensuring consistency between assigned tasks and powers and the requirements of the recruited job position.

The head of the agency employing civil servants is responsible for assigning work according to the requirements of the recruited job position, training, and monitoring and evaluating the performance of duties and responsibilities of civil servants.

The head of the competent authority for recruiting civil servants decides to arrange job positions and rank civil servants corresponding to the recruited job positions for successful civil servant candidates.

Cases of changing job positions

1. Civil servants may be appointed or not reappointed or removed from leadership and management positions according to Party regulations and laws on personnel work.

2. Professional and technical civil servants taking on other job positions with corresponding ranks with professional and technical ranks higher or lower than the ranks according to the current job position due to adjustments, rearrangement of work positions or according to regulations of competent authorities.

Change to a job position with a civil servant rank ranked according to professional and technical level higher than the current rank

The draft clearly states that agencies and organizations employing civil servants have a need for job positions with higher ranks according to professional and technical ranks, in accordance with the proportion of civil servants that need to be arranged for each job position in the agency or organization employing civil servants approved by competent authorities.

Civil servants are allowed to change to a job position with a civil servant rank ranked according to professional and technical level higher than the current rank when meeting the following standards and conditions:

a) Being classified as having completed the task well or better in the working year immediately preceding the year of changing job position; having good political qualities and ethics; not being subject to disciplinary action; not being subject to a disciplinary decision; not being under prosecution, investigation, prosecution, or trial; not being subject to disciplinary regulations according to Party regulations and the law;

b) Have results in performing tasks through quantity, quality and progress of products at the current job position;

c) Have sufficient capacity, professional qualifications and skills to take on a job position with a civil servant rank ranked in terms of expertise and skills higher than the current civil servant rank in the same professional field according to the requirements of the job description and competency framework.

According to the draft, based on the number of assigned staffing quotas and the proportion of civil servants to be arranged according to job positions approved by competent authorities, the head of the agency or organization employing civil servants is responsible for developing a specific plan as a basis for reviewing and making a list of civil servants who meet the standards and conditions for changing job positions with civil servant ranks ranked according to professional and technical levels higher than the current civil servant ranks, and reporting to the civil servant management agency to decide on changing civil servant job positions.

The head of the civil service management agency decides to arrange for a new job position and rank the civil service rank corresponding to that new job position.

The head of the agency or organization employing civil servants is responsible before the law for the standards and conditions of civil servants whose job positions are changed; and assigns tasks corresponding to the newly arranged job positions according to the provisions of law.

Change to a job position with a civil servant rank ranked in terms of expertise and profession lower than the current rank

According to the draft, changing a job position with a civil servant rank ranked in terms of expertise and profession lower than the current rank is carried out in the following cases:

a) Civil servants do not meet job requirements;

b) Civil servants who voluntarily apply to change to a job position with a civil servant rank ranked in terms of expertise and professional skills lower than the current rank.

Based on the results of monitoring, evaluating and classifying quality for the case specified in Point a above or the request for the case specified in Point b above, the head of the agency or organization employing civil servants is responsible for reporting to the head of the civil servant management agency to decide on the arrangement to a new job position and the civil servant rank corresponding to that new job position.

The Ministry of Home Affairs said that the addition of this Section aims to define the specific roles and tasks in the arrangement of job positions and civil servant ranks for those who are recruited as civil servants; the responsibility of the head of the agency using civil servants to assign work in accordance with the requirements of the recruited job position, training, monitoring and evaluating the performance of duties and responsibilities of civil servants. Regulate cases of changing job positions with corresponding ranks with higher professional and technical levels than the current job position or cases of being assigned to lower job positions due to not meeting the requirements of the tasks; determine the responsibility of the head of the agency using civil servants in developing a specific plan as a basis for reviewing and making a list of civil servants who meet the standards and conditions for changing job positions with civil servant ranks ranked according to professional and technical levels higher than the current civil servant rank, and reporting to the civil servant management agency to decide on the change of civil servant job positions. These contents reflect the spirit of the Law on Cadres and Civil Servants 2025 in arranging and managing civil servants according to job positions.
