How do military service get priority in civil service exams?

Recently, Nguoi Dua Tin has received a number of questions from readers regarding military service. Among them, there is a question about the issue of adding priority points in civil service exams after completing military service.

In what cases is military service considered completed?

Article 21 of the 2015 Law on Military Service clearly states that the term of service in peacetime for non-commissioned officers and soldiers is 24 months. This period is calculated according to the provisions of Clause 1, Article 22 of the 2015 Law on Military Service as follows:

- Calculated from the date of military transfer.

- In case of not handing over or receiving concentrated troops, the calculation is from the date the Army unit receives them until the competent authority decides to discharge them.

Accordingly, in Article 43 of the Law on Military Service, the conditions for discharge include:

- Non-commissioned officers and soldiers whose term of active service has expired;

- Discharged from the military before the term ends when the Military Medical Examination Council concludes that the person is not healthy enough to continue serving in the military;

- Being the only worker who must directly support relatives who are unable to work or have not reached working age; in a family that has suffered serious damage to people and property due to accidents, natural disasters, or dangerous epidemics (with confirmation from the People's Committee);

- A child of a war invalid or a person infected with Agent Orange whose working capacity is reduced by 61% - 80%;

- Children of martyrs, children of first-class disabled soldiers;

- A brother or a younger brother of a martyr;

- One child of a second-class disabled veteran; one child of a sick soldier, one child of a person infected with Agent Orange with a working capacity reduction of 81% or more.

Thus, if falling into one of the seven cases mentioned above, citizens participating in military service will be discharged, equivalent to having completed military service.

How do people who have completed military service get priority in taking civil service exams?

According to Point g, Clause 3, Article 50 of the Law on Military Service 2015, non-commissioned officers and soldiers who are discharged from the army upon returning to their localities are given priority in job placement and points in recruitment of civil servants and public employees by authorities at all levels, agencies and organizations; during the probationary period, they are entitled to 100% of the salary and allowances of the recruitment category corresponding to their training level.

At the same time, pursuant to Article 5 of Decree 138/2020/ND-CP, priority points are stipulated in the recruitment of civil servants. Specifically, those who have completed military service are subject to priority in the recruitment of civil servants, specifically, 2.5 points are added to the results of round 2.

In addition, people who have completed military service and want to apply for civil service must meet the registration conditions as prescribed in Article 4 of Decree 138/2020/ND-CP.

Specifically, the conditions for registering for civil servant recruitment are implemented according to the provisions of Clause 1, Article 36 of the Law on Cadres and Civil Servants. The agency employing civil servants determines other conditions according to the requirements of the recruitment position specified in Point g, Clause 1, Article 36 of the Law on Cadres and Civil Servants, in accordance with the competency framework of the job position but not lower than the general standards, not contrary to the provisions of law, not distinguishing between types of training and reporting in writing for the civil servant management agency to consider and decide.

According to Clause 1, Article 36 of the Law on Cadres and Civil Servants 2008, people who meet the following conditions, regardless of ethnicity, gender, social class, belief, or religion, can register to apply for civil service recruitment: Having only one nationality, Vietnamese nationality; Being 18 years of age or older; Having an application; Having a clear background; Having appropriate diplomas and certificates; Having good political qualities and ethics; Being healthy enough to perform the duties; Other conditions as required by the recruitment position.

The agency employing civil servants determines other conditions according to the requirements of the recruitment position in accordance with the competency framework of the job position but not lower than the general standards, not contrary to the provisions of law, not distinguishing between types of training and reporting in writing for the civil servant management agency to consider and decide.
