Infrastructure construction project in the central area of ​​Lak Lake tourist site: When will compensation and site clearance be completed?

The project to build infrastructure for the central area of ​​Lak Lake tourist site in Lien Son town (Lak district) approved by the Provincial People's Committee at the end of 2021 is good news for people in the planning area in residential group 2 (Lien Son town).

According to the plan, compensation for land clearance (GPMB) will be implemented in 2022, but so far it has not been done. People here are waiting every day to "settle down and make a living".

The project to build infrastructure in the central area of ​​Lak Lake tourist site is implemented in the period of 2021 - 2025, with a total cost of more than 130 billion VND (of which the compensation cost for site clearance is more than 73.7 billion VND), invested by the Provincial Management Board of Civil and Industrial Construction Investment Projects. The project focuses on upgrading Au Co Street (starting from the intersection of the District Political Center to the District Party Committee headquarters), with a total length of over 2 km and upgrading a road corridor with a length of 1 km (from Lak Resort to the District Police headquarters).

A kitchen of a resident in the project planning area in Lien Son town (Lak district) has become dilapidated and leaky every rainy season.

In mid-October 2022, the People's Committee of Lak district approved the plan for land acquisition, investigation, survey, measurement and inventory of the project. Accordingly, the People's Committee assigned the District Land Fund Development Center to coordinate with relevant agencies, units and individuals to conduct land status inspection, measurement, inventory of assets attached to land and complete the dossier to prepare a compensation and resettlement support plan. The unit has completed the dossier for land measurement and inventory, assets attached to land of 56 households, individuals and 1 organization, with a total area of ​​over 3.66 hectares.

The land acquisition, investigation, survey, measurement, and inventory plan for the project has been issued and implemented since the end of 2022. However, up to now, the site clearance work has not been completed, making people worried. As one of the first people to live in the planned land since 1988, Mr. Nguyen Van Tuan (72 years old, residential group 2) understands better than anyone the suffering of the people living here. According to Mr. Tuan, from 1990 to now, the district has planned this place as a tourist area, people are not allowed to build houses but wait for compensation to move elsewhere, not knowing when it will be implemented. In 2012, his children got married, his health deteriorated, and he could not bear living in a temporary house, so Mr. Tuan had to borrow money to buy land elsewhere and build a house to stabilize his life. Currently, the bank debt is 500 million VND, and each year he has to pay more than 70 million VND in interest. Being old and unable to repay the loan, Mr. Tuan hopes that the local government will quickly compensate for the land acquisition so he can pay off the debt and live the rest of his life in peace.

In 1990, from Yen Bai province, Mr. Trinh Duy Son's family (67 years old, residential group 2) settled in this area. For more than 30 years, his family has had to live in a temporary level 4 house of only 50 square meters. Mr. Son said that when he first started his career, his family of 5 lived in a temporary wooden house, which had rotted and seriously degraded over the years. In 2018, the house collapsed after a strong wind, and he had to write a petition to the local authorities to rebuild it. Seeing the difficult circumstances of his family, the authorities approved his permission to build a small level 4 house to live temporarily. However, the house was cramped and hot every time the dry season came, making life very difficult for the family. Therefore, when he heard the news of the project's launch, he was very happy to cooperate with the staff to quickly move to a new place. However, nearly half a year after the count, he still has not received compensation or relocation. He is "impatient" because his health has gradually weakened...

Many houses of people in the planning area still have to remain in their makeshift state to survive.

Head of the Department of Natural Resources and Environment of Lak district Pham Thanh said that up to now, the compensation and support plan has not been approved because in the project implementation area, there are 13 households and individuals who need to be resettled and 17 families eligible for compensation by land allocation in the resettlement area. However, up to now, the investor is still preparing procedures and documents to build a resettlement area for the project. The resettlement area has not been established and built, so the land of households eligible for resettlement and compensation by land has not been recovered. In addition, in 2023, the Provincial People's Committee will no longer authorize the District People's Committee to approve specific land prices to calculate compensation when the State recovers land. The District People's Committee has built land prices according to procedures and documents and submitted them to the Department of Natural Resources and Environment, the Land Valuation Council and the Provincial People's Committee for consideration and approval to have a basis for calculating compensation prices. To date, specific land prices have not been approved by competent authorities.

Faced with the above situation, the People's Committee of Lak district recommends that the Department of Natural Resources and Environment, the Department of Finance, and relevant departments and branches promptly appraise and submit to the Provincial People's Committee for approval specific land prices to calculate compensation when the State reclaims land to have a basis for developing a compensation, support and resettlement plan to implement the project. At the same time, the investor needs to promptly complete the procedures for establishing and constructing a resettlement area and submit it to the competent authority for approval to have a basis for developing a compensation, support and resettlement plan when reclaiming land to ensure compliance with the provisions of law.
