Clearing illegal riverside construction material storage sites

Accordingly, to improve the effectiveness and efficiency of management, the People's Committee of Ho Chi Minh City requests that departments, agencies, and the People's Committees of districts, counties, and towns seriously and decisively implement the directives of the Government, the Prime Minister , and the People's Committee of Ho Chi Minh City on strengthening the management and use of riverside land as transshipment yards for construction materials; and perform state management tasks according to the responsibilities of each unit regarding the operation of construction material transshipment yards.

The People's Committee of Ho Chi Minh City assigns the Department of Natural Resources and Environment as the focal point, to lead and coordinate with other departments and agencies; and the People's Committees of districts, counties, and towns to regularly inspect and handle violations related to the operation of construction material transshipment yards; review and guide the completion of dossiers for cases that meet the conditions for leasing land to operate construction material transshipment yards; and resolutely require local authorities to dismantle spontaneous and illegally operating construction material transshipment yards.

The City People's Committee's advisory body will issue regulations on auctioning the right to use alluvial land along the riverbanks for use as transshipment yards for construction materials in the city, ensuring compliance with the Law on Auction of Assets and the Land Law 2024; completion time is October 2024.

The Department of Transport will review, update, adjust, and supplement the list of riverbed sand and gravel collection points and riverside construction material transshipment points in accordance with regulations. It will strengthen inspections of inland waterway terminals operated by organizations and individuals involved in riverbed sand and gravel collection and riverside construction material transshipment. Regular inspections and strict handling of illegal inland waterway terminal operations will be conducted, promptly preventing the illegal loading of construction materials onto storage areas.

Strengthening measures to address the issue of overloaded vehicles transporting construction materials from transfer yards, especially in areas with many construction material collection and transfer yards along the Red River and Duong River banks, has caused damage and degradation to many sections of the embankment surface...

The Department of Agriculture and Rural Development is strengthening inspections, checks, and handling of violations affecting dike safety and flood control. It is inspecting and reviewing the operations of riverbed sand and gravel collection points and riverside construction material transshipment points of organizations and individuals; and handling violations in accordance with laws on irrigation, dikes, and disaster prevention and control during the rainy season.

The city inspectorate will inspect, monitor, and urge the implementation of inspection conclusions regarding cases of illegal management and use of riverside land as transshipment yards for construction materials within the city.

The city police are intensifying efforts to address violations at construction material transshipment yards along the river, proactively coordinating with police in neighboring provinces to prevent and combat crimes and violations of laws regarding illegal riverbed sand mining. They are directing district and town police to increase patrols, promptly detect, arrest, and decisively and strictly handle owners of vessels using boats to illegally extract sand from the river and stockpile sand and gravel at transshipment yards.

The People's Committees of districts, counties, and towns shall strengthen inspections and reviews of river sand and gravel collection points and construction material transshipment points along the river that do not meet operating conditions. Immediately implement the plan to forcibly remove construction materials from construction material storage areas of units operating illegally in the area...

The People's Committees of communes, wards, and towns shall regularly inspect and handle violations in the operation of construction material transshipment yards in their areas, preventing the emergence or recurrence of illegal construction material transshipment yards. They shall revoke any documents in the form of contracts or other forms that allocate or lease land to organizations and individuals using riverside land that is in fact being used as illegal construction material transshipment yards.
