20% reduction in staffing, excluding education and health officials in units not directly implementing the arrangement

According to the Ministry of Home Affairs, cadres, civil servants, public employees and workers in agencies and units that do not directly implement organizational restructuring but streamline staff, restructure and improve the quality of cadres, civil servants and public employees do not include education and health sector employees.

On May 5, the Ministry of Home Affairs issued Official Dispatch No. 2034/BNV-TCBC on instructions for implementing Decree No. 178/2024/ND-CP and Decree No. 67/2025/ND-CP of the Government to ministries, ministerial-level agencies, agencies under the Government; Provincial Party Committees, City Party Committees directly under the Central Government; People's Committees of provinces and centrally run cities.

Regarding the implementation of streamlining the payroll, restructuring and improving the quality of cadres, civil servants and public employees, the Ministry of Home Affairs said that when assessing the impact in the process of building policies and regimes for cadres, civil servants, public employees and workers in the process of reorganizing the apparatus of the political system, this agency reported to the competent authority a plan to reduce 20% of the payroll (excluding civil servants in education and health).

Accordingly, cadres, civil servants, public employees and workers in agencies, organizations and units do not directly implement organizational restructuring but streamline staff, restructure and improve the quality of cadres, civil servants and public employees, excludingeducation and health sector employees.

For commune-level administrative units that remain the same (not rearranged), the Ministry of Home Affairs guides that commune-level administrative units that remain the same (not rearranged) will receive functions and tasks from the district level and receive tasks according to decentralization from the provincial level. At the same time, receive cadres and civil servants from the provincial and district levels along with cadres and civil servants at the commune level to arrange according to the new commune-level government model.

Accordingly, cadres and civil servants expected to be assigned to work in new communes are all directly affected by the implementation of organizational restructuring and are subject to Decree No. 178/2024/ND-CP dated December 31, 2024 (amended and supplemented by Decree No. 67/2025/ND-CP dated March 15, 2025).

Regarding public service units managed by the district level, which are reorganized according to the new commune-level administrative unit, the Ministry of Home Affairs determines that civil servants and employees working in these public service units are directly affected by the implementation of organizational restructuring and are subject to Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP).

Regarding public service units managed by the district level, which are transferred to the commune level for management, the Ministry of Home Affairs determined that civil servants and employees working in these public service units are not directly affected by the organizational structure arrangement and are not subject to Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP).

Thus, these public service units implement staff streamlining, restructuring and improving the quality of civil servants, then civil servants are subject to Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP), excluding civil servants in education and health care .

Previously, on April 26, the Ministry of Home Affairs issued Document No. 1814/BNV-TCBC guiding the implementation of Decree No. 178/2024/ND-CP dated December 31, 2024 (amended and supplemented by Decree No. 67/2025/ND-CP dated March 15, 2025).

Through the implementation process, up to now, at the request of some localities, the Ministry of Home Affairs continues to issue Official Dispatch No. 2034/BNV-TCBC.

The document aims to provide additional guidance on the implementation of policies and regimes for cadres, civil servants, public employees and workers in the organizational arrangement of the political system.
