"Naming and shaming" 40 violating projects

Faced with the reality of many projects being abandoned or delayed for a long time, at the 14th session held on March 23 and 24, 2016, the delegates of the 14th Hai Phong City People's Council unanimously passed Resolution No. 06/2016/NQ-HDND on tasks and solutions to recover land areas that were assigned or leased to the wrong subjects, without proper authority, or were slow to put into use or used for the wrong purpose, causing waste of land resources.

Accordingly, the Hai Phong City People's Council requested the Hai Phong City People's Committee to review and carry out procedures to reclaim project land from 40 organizations and enterprises that have signs of violating land laws with a total area of nearly 300 hectares. At the same time, review projects that are behind schedule and have been abandoned for many years to handle them according to regulations.

According to information from the People's Committee of Hai Phong City, implementing Resolution No. 06, from 2016 to present, the People's Committee of Hai Phong City has directed relevant departments, branches, and local authorities to focus on reviewing, inspecting, reporting, and proposing solutions to handle the above projects according to the law.

To date, the People's Committee of Hai Phong City has issued decisions to revoke 13 projects with a total area of nearly 246 hectares out of 40 projects "named and shamed" by the 14th City People's Council. Of these, the land revocation of 12 projects with a total area of more than 200 hectares has been completed.

Currently, Hai Phong city has approved a plan to refund the legal investment value to the enterprise, and will refund when handing over the land to the new investor.

Regarding the remaining 27 projects, up to now, the People's Council of Hai Phong City has approved to remove from Resolution No. 06 the project of Union Success Company Limited in Hoa Binh Commune, Thuy Nguyen District, Hai Phong City with a total area of 29.45 hectares.

Hai Phong City People's Committee plans to propose to remove from Resolution No. 06 17 projects with a total area of 12.56 hectares. Of these, 10 projects, after being inspected and sanctioned by the authorities, the investors have proactively corrected the violations, 3 projects are allowed to be implemented in accordance with urban planning and are within the scope of land acquisition to implement resettlement projects combined with parking lots and renovation of old apartments.

Hai Phong City authorities have extended the land use period for 6 projects. Of these, 4 projects have completed their items within the extended period, 1 project is in the extended period and 1 project is past the extended period but still slow to implement. Currently, Hai Phong City People's Committee is carrying out land recovery procedures.

For the remaining 3 projects, 2 projects currently owe land rent, 1 project owes late payment fines. Currently, Hai Phong City authorities are handling tax violations before considering repossession procedures.

Create conditions for investors with needs and capacity

In addition to the 40 projects listed in the appendix of Resolution No. 06, from 2016 to present, the People's Committee of Hai Phong City has also directed relevant departments, branches, and local authorities to conduct inspections and reviews of 254 projects with signs of violations in land management and use with a total area of nearly 2,300 hectares.

Based on reports from departments, branches and localities, up to now, the People's Committee of Hai Phong City has issued decisions to reclaim land for 18 projects with a total area of nearly 210 hectares. Of which, the land reclamation of 12 projects has been completed. At the same time, there are documents to stop implementation, revoke, and cancel the legal value of documents issued for 68 projects with an area of nearly 840 hectares.

To facilitate investors with capacity and demand, Hai Phong City authorities have extended the implementation progress by 24 months for 66 projects (466.11 hectares) and are carrying out extension procedures for 3 projects (38.03 hectares).

According to information from the People's Committee of Hai Phong City, implementing Resolution No. 06, in the coming time, the People's Committee of Hai Phong City will direct the Department of Natural Resources and Environment of Hai Phong together with departments, branches and localities to resolutely and completely handle projects that have had decisions on land reclamation.

For the recovered land area, promptly develop a plan to auction land use rights to put the land into use according to the planning, contributing to increasing the State budget revenue as well as developing the local socio-economy.

For projects that have been extended, Hai Phong City People's Committee requires investors to urgently complete the items according to regulations. After the extension period, if the investor continues to delay implementation, Hai Phong City will resolutely reclaim the land .
