No forbidden zones, no exceptions in fighting smuggling and trade fraud

DNO - The City People's Committee has just issued Plan No. 139/KH-UBND dated May 22, 2025 to launch a peak period of fighting to prevent and repel smuggling, trade fraud, and infringement of intellectual property rights in Da Nang city, in order to protect the legitimate rights and interests of people and businesses, protect security and health for people, and contribute to the rapid and sustainable development of Da Nang city in particular and the country in general.

Accordingly, the City People's Committee assigned the City Police to direct local police and professional units to strengthen their grasp of the situation, detect, combat, prevent and promptly handle violations; focus on investigating and destroying smuggling rings and gangs, manufacturing and trading counterfeit goods, committing commercial fraud, infringing intellectual property rights, and those of unknown origin during peak periods, with special attention to groups of medicines, milk of all kinds, and health protection foods.

The process of fighting needs to clarify the roles and responsibilities of organizations and individuals in the management of licensing, inspection, import control, circulation... of raw materials for goods production, strictly handle corruption and negative acts in accordance with the provisions of law with the motto "handling one case to warn the whole region, the whole field", "no forbidden areas, no exceptions".

The City Police are responsible for speeding up the investigation and verification of complicated cases of smuggling and counterfeiting involving many subjects, closely coordinating with the People's Procuracy and People's Courts at all levels to promptly prosecute and strictly try them before the law, contributing to general deterrence and prevention. Through prevention and combat, proactively detect, advise and recommend all levels and functional sectors to promptly overcome loopholes and shortcomings in the work of preventing and combating smuggling, trade fraud and counterfeiting. Increase forces to the grassroots to organize and mobilize the masses to actively participate in preventing and combating smuggling, trade fraud and counterfeiting during this peak period.

The City People's Committee requested the City Border Guard Command to strengthen patrols and control of border areas, sea areas, waterways... to promptly detect, prevent, and combat smuggling, trade fraud, counterfeit goods, and intellectual property infringement, ensuring the maintenance of order and safety in border areas. Strengthen propaganda and mobilize people to strictly comply with the provisions of the law, actively denounce crimes, and not participate in or assist in smuggling and illegal transportation of goods in border areas.

The City Military Command focuses on inspecting, reviewing, and strictly implementing regulations on management and use of defense land to promptly prevent and not allow subjects to take advantage of the production of counterfeit goods, storage, and transit of smuggled and prohibited goods, and infringement of intellectual property rights... in the defense land area managed by the unit.

The City People's Committee assigned the Department of Industry and Trade to direct the Da Nang Market Management Department to strengthen inspection and strictly handle cases of smuggling, production and trading of counterfeit goods, goods infringing on intellectual property rights, and goods of unknown origin in the city, especially violations in the e-commerce environment.

Through the results of inspection, review, handling and evaluation, pointing out the causes and conditions of violations, loopholes and shortcomings in legal regulations or management mechanisms that subjects take advantage of to violate the law to propose solutions to competent authorities. Urgently advise the City People's Committee to establish a Working Group with appropriate participants to direct, inspect and urge departments and branches in the city to implement this Peak Plan.

The Department of Health is responsible for presiding over and coordinating with relevant agencies to strengthen inspection, examination and control of the trading of pharmaceuticals, cosmetics, health protection foods; medicines..., strengthen inspection and control of retail stores, pharmacies, and pharmaceutical and drug trading enterprises; promptly prevent and strictly handle cases of trading in smuggled drugs, fake drugs, counterfeit pharmaceuticals, and drugs of unknown origin in the city.

The Department of Culture, Sports and Tourism strengthens monitoring, inspection and supervision of compliance with legal regulations on advertising and trading goods via the internet and social networks, especially goods related to medicines, milk and health protection foods, cosmetics and pharmaceuticals.

The Department of Science and Technology organizes inspections and checks on the implementation of goods measurement and quality of goods of wholesale and retail production and business establishments in the city to promptly detect fraudulent methods of measurement and packaging to increase prices and make illegal profits. Strengthen the implementation of State management on the quality of goods in circulation; monitor and warn about consumer goods with signs of not ensuring quality in circulation on the market so that competent agencies can strengthen control and consumers are informed, avoiding losses when exchanging and buying and selling.

The City People's Committee assigned the Department of Agriculture and Environment to direct relevant units to strengthen inspection and strictly handle violations of forestry products, aquatic products, production and trade of fake plant varieties, livestock, fertilizers, and pesticides in the city.

At the same time, the City Food Safety Management Board is assigned to strengthen inspection and post-inspection of food safety, strictly handle acts of trading in fake, toxic, and unknown-origin food. Strengthen propaganda and education on food safety and hygiene laws; encourage people to actively participate in detecting and denouncing businesses with signs of trading in fake, dirty, and smuggled food in the city.

The Customs Branch of Region XII is responsible for strengthening inspection and strict control of the seaport gate area, the International Civil Aviation Port, the Central Transportation and Warehousing Center and other locations under Customs control; identifying subjects, key goods, and methods of operation; strengthening inspection, control, detection, prevention, arrest and timely handling of smuggling, trade fraud, counterfeit goods and illegal transportation of goods across the border.

In addition, direct units to do a good job in professional work, collect information and coordinate closely with related units (Police, Tax Department, Market Management Department, City Border Guard) to promptly detect and handle subjects of smuggling, tax evasion, transporting prohibited goods, and counterfeit goods of Vietnamese origin.

The Tax Department of Region XII strengthens inspection and examination to combat tax loss, tax declaration, tax settlement, and tax refund to combat tax fraud; promptly exchanges information, closely coordinates with functional forces in investigating, verifying and handling smuggling, trade fraud, and counterfeit goods related to tax management.

The City People's Committee assigned the People's Committees of districts to direct the ward and commune levels to strengthen management, grasp the local situation, promptly detect, prevent and coordinate with functional agencies to strictly handle violations of smuggling, production and trade of counterfeit medicines, milk and health protection foods.

The City People's Committee requested the Vietnam Fatherland Front Committee of Da Nang City to step up the dissemination of knowledge to the people about regulations related to the fight against smuggling, trade fraud, counterfeit goods, and goods infringing intellectual property rights; mobilize the people to actively participate in detecting, denouncing, and fighting against smuggling, trade fraud, and counterfeit goods, with special attention to the group of fake milk, fake medicine, and fake health protection foods.

The City People's Committee requests the City Steering Committee 389 to monitor, direct, inspect and urge departments, branches and sectors in the city to implement the above-mentioned Peak Plan; report the implementation results to the National Steering Committee 389 and the City People's Committee.
