Don't let stalled planning projects become a "debt" to the people.

On the morning of November 7th, National Assembly deputies discussed in their respective groups the draft Law on Planning (amended); and the draft Law amending and supplementing a number of articles of the Law on Urban and Rural Planning. The deputies' opinions all showed their dedication to the issue of planning implementation – a "hot" topic that receives significant public attention.

Regarding the draft Law on Planning (amended), National Assembly Deputy Nguyen Thi Yen (Ho Chi Minh City) argued that there must be clear decentralization and delegation of authority in planning implementation to avoid overlaps and difficulties in execution. “I propose that the level that approves the plan should also decide on plan adjustments. The recent Law on Planning has a short lifespan and frequent adjustments, significantly impacting the people. Therefore, it is necessary to ensure the stability of the planning law,” Deputy Nguyen Thi Yen (Ho Chi Minh City) stated.

The need for planning information to be updated and made public, and for citizens to be informed of all planning details, was also the view of some delegates.

Representative Nguyen Van Loi (Ho Chi Minh City) stated: Planning information must be made public so that people know about the future development of the area, of the land where they live. This information must be made public on digital platforms and national and local exhibition centers. Representative Nguyen Minh Duc agreed with Representative Nguyen Thi Le's opinion that planning information must be made public and transparent to the people, avoiding situations where people are "shocked" to find their land included in the planning.

Representative Nguyen Quang Huan (Ho Chi Minh City) agreed on the authority to organize planning: The Government organizes the preparation of the national master plan; ministries organize the preparation of the national marine spatial plan, national land use plan, sectoral plan and regional plan; provincial People's Committees organize the preparation of provincial-level plans.

However, National Assembly Deputy Hoang Van Cuong ( Hanoi ) proposed that the national master plan, national land plan, and national maritime spatial plan should still be approved by the National Assembly. As for sectoral plans, they should still be drafted by an interdisciplinary council, and the Prime Minister should be the one to approve them to avoid the fragmented nature of each sector.

The opinions of the delegates from Ho Chi Minh City also agreed that the principle of ensuring lower-level planning is consistent with higher-level planning must be maintained, and that Ho Chi Minh City's planning must be unique, ensuring its characteristics as a megacity.

Representative Tran Anh Tuan (Ho Chi Minh City) argued that detailed sectoral and regional planning are unnecessary, stating that "a national master plan, sectoral plans, and provincial plans are sufficient."

Representative Nguyen Van Loi (Ho Chi Minh City) raised the issue: If provincial planning has to wait for overall planning and sectoral planning, it could easily take 2-3 years, or even an entire term. Therefore, he proposed allowing the simultaneous creation of plans to ensure sufficient time: any issues that do not conflict with the Central Government should be handled directly by the localities, while any conflicts should be reported to the Central Government.

Representative Nguyen Van Loi also suggested integrating zoning plans, urban plans, and rural plans into the overall master plan, because the overall socio-economic plan already encompasses everything.

Representative Nguyen Minh Duc (Ho Chi Minh City) expressed concern about the issue of stalled planning, which has significant negative consequences, causing immense difficulties for citizens who are unable to obtain permits for construction, repairs, or property transfers. He emphasized the need for effective adjustments to planning schemes, preventing them from becoming a burden on the people. The representative also stressed that the most important thing is to avoid conflicts between different planning schemes.

National Assembly Deputy Nguyen Truc Anh (Hanoi) argued that the national master plan is crucial, defining the nation's vision and development strategy for a specific number of years. Therefore, she proposed that the Strategic Policy Committee be the lead agency in developing this plan, and that it should be reviewed and supplemented every five years, linked to the National Congresses. The national plan in the draft Law on Planning (amended) should serve as the foundation for establishing measurable indicators and for evaluating the effectiveness of the plan.

The national master plan must be linked to the Law on Statistics and national overall data, because the planning indicators must be accurate and substantive. Furthermore, specialized plans should not be rigid, because life is constantly changing, and specialized ministries and the Government should proactively develop plans to serve as a basis for determination.

Notably, Representative Nguyen Truc Anh proposed the establishment of a "planning police force" to monitor the implementation of planning, and emphasized the need to raise awareness of adhering to planning regulations.

Commenting on the draft Law amending and supplementing a number of articles of the Law on Urban and Rural Planning, National Assembly Deputy Nguyen Quang Huan (Ho Chi Minh City) questioned whether this law is necessary, arguing that urban and rural planning should be included in the national master plan, while matters related to landscape should be included in sectoral planning.

Representative Pham Trong Nhan (Ho Chi Minh City) proposed considering the planning of Ho Chi Minh City and Hanoi as special urban areas and suggested the early adoption of the law on special urban areas for Ho Chi Minh City. Representative Nguyen Van Loi also proposed assigning Ho Chi Minh City the task of developing a super-city plan for Ho Chi Minh City.

Representative Nguyen Truc Anh (Hanoi) suggested that in provincial and city planning, there should only be one plan, not multiple plans, to avoid waste; the general plan should be set at 1/10,000 scale, and detailed plans at 1/2,000 or 1/500 up to 1/1,000 scale (depending on the specific characteristics of the region), and it is reasonable to leave the decision-making to the local authorities. Once the planning project is completed, it must be made public to the people; the authority to approve plans from zoning to detailed urban design and landscape architecture should be decentralized to the commune level.
