The Housing Management and Construction Inspection Center (HMCIC) under the Ho Chi Minh City Department of Construction has submitted a proposal to the Department of Construction regarding the application of transitional regulations on land price tables to calculate financial obligations according to Decision No. 79.

Specifically, Decision No. 79 on adjusting land price tables in Ho Chi Minh City, effective from October 31st, stipulates that the fee for transferring the right to use old state-owned housing (for cases before July 5th, 1994, and from July 5th, 1994 to January 19th, 2007) will be calculated according to the price table at the time of signing the purchase and sale contract.

At the same time, according to Decree No. 95, homebuyers can submit applications to purchase housing at the housing management unit or the housing management agency as prescribed by the representative agency of the house owner. This means that applications submitted to HMCIC or the housing management agency under the Department of Construction are all valid.

However, Decision No. 79 stipulates that only competent state agencies are allowed to receive applications for purchasing houses. This raises concerns about whether applications submitted to housing management and operation units (not state agencies) are subject to the transitional provisions of Decision No. 79.

Therefore, to clarify the transitional regulations, HMCIC proposes allowing applications submitted before October 31st to be subject to the price list in effect at the time of application, avoiding excessively high financial obligations due to changes in new land prices.

As of November 1st, HMCIC has received 786 applications to purchase old public housing and is processing them to report to the Department of Construction and submit them to the Council for Determining the Value of Old Housing.

HMCIC found that if the new land price list were applied, the financial obligations of citizens could increase by 4 to 7 times compared to the old list, causing difficulties for people. Therefore, the unit proposed that the Department of Construction submit a request to the Ho Chi Minh City People's Committee to allow the application of the old land price list for applications submitted before October 31st.

In addition, HMCIC also recommended that the Ho Chi Minh City People's Committee approve applications for house purchases submitted to management units such as the Center for Housing Management and Construction Inspection, the Ho Chi Minh City Housing Business Management Company Limited, or the Department of Construction, all of which should be subject to the transitional provisions in Decision No. 79.

It is known that Ho Chi Minh City currently has approximately 10,000 state-owned properties that are either leased or vacant. For those currently leased, the city plans to sell them at subsidized prices to eligible individuals or state officials. To purchase these properties, citizens must submit applications according to legal regulations; however, the current procedures still face many difficulties.
