Consulting on the draft Law amending and supplementing a number of articles of the Law on Product and Goods Quality

Attending the workshop were: representatives of the Standing Committee of Science, Technology and Environment; representatives of the Ministry of Science and Technology ; representatives of a number of relevant ministries, branches and Vietnamese enterprises and industry associations.

The draft Law amending and supplementing a number of articles of the Law on Product and Goods Quality is expected to be submitted to the National Assembly for comments and consideration for approval at the upcoming 9th Session. After many times of collecting comments on the draft Law, up to this point, the draft Law amends and supplements 32 articles, adds 3 articles, removes 9 articles and 3 clauses out of a total of 7 chapters and 72 articles of the current Law.

Thus, up to this point, the draft Law has 6 chapters and 66 articles. The revised content in the articles focuses on 4 groups of policies already included in the Law on Product and Goods Quality, but updated, supplemented, and adjusted to suit the actual situation and the development level of science and technology.

At the workshop, opinions stated that the draft Law has amended and supplemented many contents to complete the important legal corridor, creating unity and synchronization for the implementation of product and goods quality management activities (in production, export, import, circulation on the market and during use); in which, many contents are directly related to the rights and obligations of organizations and individuals producing and trading products and goods and organizations and individuals with activities related to product and goods quality; product and goods quality management.

Regarding the application of law, the draft Law adds the content of "safety and quarantine" of product and goods quality to the scope of regulation (Clause 1, Article 4). However, this content has also been regulated in specialized laws on veterinary medicine, food safety, plant protection and quarantine.

Therefore, Nguyen Ngoc Son, a member of the National Assembly who works full-time at the Committee for Science, Technology and Environment, said that the application of the law as stipulated in Clause 1, Article 4 will likely expand the scope of regulation related to the contents already stipulated in the law on food safety, veterinary medicine, plant protection and quarantine; causing conflicts and overlaps with the scope of regulation of related laws.

It is said that currently, animal feed products and goods are subject to the Law on Animal Husbandry and the Law on Veterinary Medicine. The representative of the Vietnam Animal Feed Association proposed to clearly separate when to apply the law according to the provisions of this Law and when to apply the law according to specialized laws.

Regarding the management of quality of border trade goods and e-commerce goods, some opinions ask how to manage and control the quality of these products and goods?

Providing more information at the workshop, Acting Chairman of the Vietnam Standards and Metrology Committee Ha Minh Hiep said that the draft Law has set out principles for managing the quality of border trade goods. Because border trade goods are very diverse in the market and their quality is also very different, the draft Law assigns responsibility to the Government and relevant ministries to provide specific guidance on quality management.

Regarding the management of goods by group, there are opinions agreeing that the draft Law assigns the Government to regulate the classification of product and goods categories, especially the identification of group 2 products and goods (products and goods that are potentially unsafe). There are opinions suggesting to clarify the principles for identifying group 2 goods and to propose management principles for goods in this group.

Receiving comments at the workshop, Nguyen Ngoc Son, a member of the National Assembly who works full-time at the Committee for Science, Technology and Environment, said that the Standing Committee of the Committee for Science, Technology and Environment will continue to coordinate with the drafting agency to absorb and complete the draft Law before submitting it to the National Assembly; hoping that experts and professional associations will continue to coordinate with the drafting agency and the reviewing agency in the process of completing the draft Law.
