At the discussion session in the afternoon of October 31 to give comments on the draft Law on Cyber ​​Security, some National Assembly deputies said that when the Law on Cyber ​​Security is passed, it will contribute to paving the way for digital transformation development and protecting national security in cyberspace.

Clarifying some issues of the Law on Cyber ​​Security, Vice Chairman of the National Assembly , Senior Lieutenant General Tran Quang Phuong said: This Law on Cyber ​​Security cannot cover everything but must pave the way for digital transformation to develop. Many contents up to this point have been basically agreed upon by the agencies of the National Assembly, in which the new thing is the provisions on principles in the law.

According to Vice Chairman of the National Assembly Tran Quang Phuong, regarding the responsibility of State management, it is currently scattered in the laws, so it is necessary to assign the Government to specify in detail, in accordance with the provisions of the Law on Organization of the Government.

Commenting on the draft Law on Cyber ​​Security, Lieutenant General Le Quang Dao, Deputy Chief of the General Staff of the Vietnam People's Army, National Assembly delegate of Dak Lak province, said:

Firstly, regarding the military information system stipulated in Clause 2 and Clause 3, Article 15, Lieutenant General Le Quang Dao proposed replacing the phrase "Military information system" with the phrase "Important information system on national security under the management scope of the Ministry of National Defense".

Second, in Clause 5, Article 18; Point b, Clause 4, Article 22 and Clause 5, Article 23; Point b, Clause 4, Article 24; Point b, Clause 2, Article 32, Lieutenant General Le Quang Dao proposed to replace the phrase "Military information system" with the phrase "Information system of agencies and organizations under the management of the Ministry of National Defense".

Delegate Le Quang Dao said that such revision does not expand the scope of the Ministry of National Defense but is also consistent with the provisions of current laws related to the authority and responsibility of the Ministry of National Defense through laws such as: Law on National Defense 2018, Law on Protection of State Secrets 2018, Law on Information Security 2015 and Law on Telecommunications. At the same time, it is also consistent with the practice in managing and exploiting contents related to military and defense work.

“As you know, Resolution No. 29 of the Politburo clearly stipulates the strategy for protecting the Fatherland in cyberspace, stating that the Ministry of National Defense is in charge of advising the Government on state management of military and defense tasks, and protecting national sovereignty in cyberspace. These are extremely important contents. And Resolution No. 30 of the Politburo also states that the strategy for protecting national security determines that the People's Army and the People's Public Security play a core role in protecting cyber security,” said delegate Le Quang Dao.

Delegate Luong Van Hung, National Assembly Delegation of Quang Ngai province, said that the draft law has many positive points when specifying prohibited concepts and behaviors, as well as the responsibilities of ministries, branches, businesses and users, meeting the practical requirements of the national digital transformation process, ensuring security and safety in cyberspace, while protecting human rights, civil rights and legitimate interests of organizations and individuals.

Specifically, commenting on the responsibilities of organizations and individuals using cyberspace (Article 56), delegate Luong Van Hung said that the draft law's provisions are still general in nature and do not clearly show the responsibilities of account owners in cases where accounts are exploited to commit violations.

“I propose clarifying the principle of “only handling when there is an error” and adding the obligation to promptly notify the authorities when violations are detected. Adding the right of users to access, know, and complain when personal data is illegally collected and processed,” delegate Luong Van Hung stated.

In addition, delegates also proposed establishing a mechanism to receive and respond to information from people about cybersecurity violations, in order to improve coordination efficiency and transparency in management.
